It's Mabo Day today.

Observed during National Reconciliation Week, Mabo Day commemorates Eddie Koiki Mabo and the historic 1992 High Court decision that overturned terra nullius - the false legal doctrine that claimed Australia was “land belonging to no one” before colonisation.

The Mabo decision was one of the most significant legal rulings in Australian history. It recognised that Aboriginal and Torres Strait Islander peoples’ rights to Country existed long before British colonisation and could continue to exist under Australian law through Native Title.

This decision fundamentally changed the legal understanding of land ownership in Australia. It led to the introduction of the Native Title Act 1993, creating a legal framework for Aboriginal and Torres Strait Islander peoples to make native title claims.

More than a legal milestone, Mabo was a powerful act of truth-telling that challenged the foundations of colonisation and recognised the enduring connection Aboriginal and Torres Strait Islander peoples have to land, waters, law and culture.

As a key date within National Reconciliation Week, Mabo Day reminds us that reconciliation requires truth, recognition, justice, and ongoing structural change.

At a recent all staff day, the team at Women’s Legal Service Queensland had the privilege of hearing from Professor Megan Davis AC, a Cobble Cobble woman, renowned constitutional lawyer, and one of the architects of the Uluru Statement from the Heart.

Professor Davis shared powerful insights into the current landscape for First Nations peoples, including the recent concerns raised by the United Nations about the treatment of Aboriginal and Torres Strait Islander children in Australia’s justice system. The UN Committee on the Elimination of Racial Discrimination expressed “grave concern” about systemic racial discrimination, over-policing, and the over-incarceration of First Nations children.

Her reflections highlighted the importance of truth-telling, structural reform, and ensuring First Nations voices are heard in decisions that impact their communities.

As an organisation committed to creating safer and more inclusive futures for women and children, these conversations are an important part of continuing to listen, learn, and examine the systems and structures that shape people’s experiences of justice and safety.

Thank you, Professor Davis, for your generosity, leadership, and wisdom.

The theme for National Reconciliation Week 2026 is 'All In', a call for all Australians to commit wholeheartedly to reconciliation.

🏠 24.3% of Australians escaping domestic and family violence in 2025 were unable to access the accommodation they needed.

For Aboriginal and Torres Strait Islander people, that figure rises to 41.66%.

New national data is highlighting the devastating barriers many victim-survivors still face when trying to seek safety.

From a lack of safe housing, to fears around reporting violence, to perpetrators using phones and technology to monitor and isolate.

We know safety is about more than leaving violence. It’s about having access to housing, culturally safe support, legal help, and the ability to stay connected safely.
