VISA: the Victorian Immigration Solicitors' Alliance - Bigger than Ben Hur - soon to Be BIGGER than the mia!!!

Going on the recent numbers although the Victorian Immigration Solicitors' Alliance: VISA was only formed in 2018 and the Sydney based migration agents lobby group - the mia was formed by the rum corps ages ago: VISA will be bigger by 2030!!

It is not surprising given the corruption and nepotism of the Sydney based migration agents group

All doughnut jokes aside... The Victorian Immigration Solicitors' Alliance: VISA is hosting this years Crimmigration Conference: Immigration, Crime & Punishment in Berlin!!!

As many know last year the VISA - Immigration, Crime & Punishment was held in Paris - which was a blast. But this year is shaping up to be even more amazing.

Since my youth I have loved Berlin - I first went there on a Goethe scholarship (yes I know he was from Frankfurt). Berlin has a funky st kilda 1980s vibe but cleaner!

This years "Immigration, Crime & Punishment" will be held on Unter den Linden near the Brandenburger Gate and Museum Island. Hope to see you there.

Big Citizenship Case Win – Refugee – bad criminal history – s501

Some 9 years ago, an unassumingly polite man presented at my law firm. He stuck me to be an honest man – a thoughtful man – a man who had suffered greatly, but also a fierce and fearless man.

He had come to me following his citizenship being refused on character grounds, and as a consequence, his permanent resident visa was now in peril.
He told me, in ploddingly slow and deliberately chosen words that were heavy with sorrow and longing. He spoke of the war in his homeland – of his aging parents and younger siblings – of how he had worked as a translator for the Americans and how he had believed in their promises of a brighter future. That was some 15 years ago. The Americans have long since left, turning their backs on the people and their promises.

Given his history, he fled to London – paying a people smuggler a small fortune. Shortly on arrival, he was detained. His asylum application had been stalled and appeared to be struggling. In a moment of desperation, he reached out to another people smuggler who promised asylum in Candana for a huge amount. The client sold everything he owned only to buy 12 months in an English gaol on passport issues.

Three years and many countries later, he arrives in Sydney, where he is granted protection, but one of the main purposes of this odyssey was to rescue his family and deliver them from evil, so he believed he needed Citizenship.

As soon as he applied for Australian citizenship, a cascading series of unfortunate events beset him – culminating in the department commencing proceedings to cancel his protection visa and “deport him” from Australia.
But this is when his luck turned for the better, because he found AR LAW SERVICES: Master Migration Lawyers. The matter turned on s501 and mandatory cancellation for more than 12 months in prison. (This was the incident in the UK some 10 years earlier)

Fortunately, I was able to win the case, and his PR status was returned.
And he lives in Australia happily ever after… NOT so fast.
As I said earlier, a migration agent told me he could get the client Australian citizenship.

The client returned to AR LAW SERVICES: Master Migration Lawyers about 2 years ago, and in a bout of deja vu or more fittingly Groundhog Day – he told me his Citizenship was in danger of being refused.

After numerous submissions, I am happy to report the client has just been granted (offered) Australian Citizenship.

Another Big Refugee Win - ART - Administrative Review Tribunal - Protection Visa- a win for Justice

Days before the client's matter at the ART was to be heard they learned that their dodgy migration agent had "made up" the entire refugee claim. The client was told by the agent to "go along" with the fake story if they wanted any chance.

So this dodgy agent was saying he lied but now to protect the agent the client must now also lie. But worse the agent told the client they had no chance it was an "UNWINNABLE CASE!!!"

Fortunately the client realizing the major mistake they had made by trusting this dodgy and incompetent agent - sort better representation - and in fact found the best -
they found - AR LAW SERVICES: Master Migration & Litigation Lawyers.

As soon as they told me their mournful tale I realized two things:
1) There are so many cowboys out there: dodgy migration agents - poorly trained and badly informed.
2) The client had a winnable (difficult but winnable) case - and that made the stupid lies of the prior agent a double tragedy.

I filed for an urgent adjournment and got to work with the remedial reconstruction of the case and submissions.

My confidence was today justified - the member agreed with my submission and the client won their case

Bogus Documents Case. Big Win at the ART – Big Win for Fairness

Administrative Review Tribunal Public Interest Criteria – Bogus Documents – visa refusal – Best Migration Lawyers
For over 25 years AR LAW SERVICES: Master Migration Lawyers have been assisting clients with visa problems arising from issues like PIC 4020 – both at first instance and at Appeal.

In my work with migrants, refugees and women/children at risk – I am often confronted by depressing, frustrating and harrowing tales of visa refusal or cancellation: often the cause of these unfortunate events are poorly trained, lazy, careless and negligent migration agents. However this story got my blood boiling to defcon: stroke levels… because it was a case of fraud by an agent!

This case was particularly galling because there was no need for the migration agent to commit this heinous act (true he was motivated by avarice) but to secure the visa his fraud was an unnecessary folly: For the client this was a double tragedy, firstly, no visa but secondly – and more dispiriting – their marriage was reduced to a sham!

The Facts:

The client wish to marry, however they were already married and the country the original marriage was recorded in did not allow divorce. Consequently they sort an annulment.

Having paid a huge sum of money to their migration agent, the annulment papers were produced and the migration agent then applied for the visa. The visa was refused pursuant to PIC 4020.

Bogus documents – the case officer had determined the annulment papers were counterfeit – fake – fugazi!

On closer examination of the file it was clear that the document was “bogus”, but the client swore on “the souls of their children and all the angels and saints in heaven!” that the migration agent committed the fraud independently of the client – the client was innocent!

With our instructs we went to work and discovered the path to justice.

And I am please to say after several years of toil and numerous appearances before the Tribunal, we won the case.
