Sunset clauses are commonly included in off-the-plan contracts, but many buyers aren’t fully aware of how they work or how they may affect the transaction.

A sunset clause generally sets a deadline for when a development must be completed. If the project is delayed beyond that date, the contract may allow the agreement to be ended under certain circumstances.

Because off-the-plan contracts can involve longer timeframes and more detailed conditions, it’s important to understand exactly what you’re agreeing to before signing.

We’ve broken down some key points in this carousel to help explain how sunset clauses work and why reviewing the contract carefully matters.

With ongoing discussion around tax, investment property reform and asset planning, many property owners are reviewing how their assets are structured.

Whether property is owned individually, through a company or via a trust, each structure can come with different considerations depending on your long-term goals and circumstances.

Seeking appropriate legal and financial advice can help ensure your ownership structure still aligns with your needs moving forward.

Buying off the plan can be exciting — especially when purchasing a brand-new property or securing an opportunity early in a development.

However, off-the-plan contracts can come with additional considerations that buyers should understand before committing. Construction delays, planning approvals, finance requirements can all impact settlement timeframes. In some cases, the final property may also differ slightly from the original plans or marketing material.

These contracts are often more complex than standard residential purchases and may include special conditions, sunset clauses and extended settlement periods.

Seeking advice early can help you make informed decisions and avoid unexpected surprises later in the process.

“What is an easement?” is one of the most common questions buyers ask during the conveyancing process — and for good reason.

An easement is a legal right that allows another party to use part of your land for a specific purpose, even though you still own the property. This is commonly related to services such as drainage, sewerage, electricity or access pathways.

For example, a drainage easement may restrict where you can build, extend, excavate or place structures on the land. In some cases, it may also impact future renovation or development plans.

An easement doesn’t necessarily mean you shouldn’t buy the property, but it’s important to understand exactly where it’s located and how it may affect the property moving forward.

That’s why reviewing the title and Section 32 carefully before signing is so important. Understanding these details early can help avoid costly surprises later.

Understanding AML Changes in Property Transactions

Australia’s Anti-Money Laundering (AML) regulations are changing, bringing new compliance requirements for property transactions.

These changes may mean buyers and sellers are asked to provide additional identification and source of funds information throughout the process.

While the requirements are evolving, our role remains the same — helping ensure your transaction progresses as smoothly and efficiently as possible.

If you have questions about the new AML requirements, our team is here to help.

The new First Resort Home Warranty Insurance scheme will replace the current Domestic Building Insurance system for residential buildings up to 3 storeys.

One of the biggest changes is that claims for defective or incomplete work may now be available regardless of whether the builder is insolvent, missing or deceased.

The reforms also introduce a new regulator, increased coverage limits, and stronger enforcement powers across the building industry.

If you’re buying, building, subdividing or developing property, it’s important to understand how these reforms may affect you. Call the team at DMVC to discuss further.

What is title insurance and do I need it?

As a buyer, title insurance protects you against things which are unknown to you when you settle – and which become your responsibility as the new land owners.

Title insurance can cover you for things such as unapproved and / or non-compliant building work, boundary encroachments and complete loss of legal ownership due to a fraudulent sale or mortgage of your property.

Without title insurance, you’re not protected from these things which means your ownership of the property could be affected - and cost you money

If you’re buying property, we highly recommend title insurance and we can help arrange this for you.
