Introducing the Financial Condom.

Another year has flown by and now the average life span for Baby Boomers is only four years away (2029). Wills and Estate lawyers have a lot to do to update Wills, Powers of Attorney and so on. Family lawyers will have a field day arguing over inheritances that have fallen into the property pool. Documenting advances from the Bank of Mum and Dad is no guarantee that they won't be considered a financial resource. Then there is the dreaded Erosion Principle, where the credit for assets brought into the marriage drops over time.

if you don't want to be caught up in all that confusion, there is a solution.

The Prenup. It is the only way to quarantine assets from the Family Court.They work. Read and comply with the technical requirements. Make them reasonable.

S*x sells, so I coin this phrase that is easy to remember. Think of your Prenup as the financial equivalent of a condom. Fits the Blended Family situation perfectly. They pose little risk as both parties want the same result. Wills and Estate lawyers need to include this option, given that more than 50% of second marriages fail.

Note that a Prenup can be entered into during the relationship. So it's never too late - unless you separate. Then its too late.

One of my clients sent me the following email:

My apologies it's taken me so long to let you know how deeply I appreciated your time and advice regarding my very long relationship, which sadly remains broken. Your counsel was both revealing and in a way a relief as it shows a way forward that I had no idea how to tackle.

I also appreciated our chat afterwards over coffee and I can now see why Alan and his family speak so highly of you.

Since our meeting I have managed to get through our wedding anniversary last week and I have now formed a plan that should see me formally approaching you well before Christmas with hopefully a polite separation, where I will ask my long term friend George to act as facilitator between myself and my wife.
