The minimum wage will increase by 5.2% on 1 July 2022.

The Fair Work Commission announced the increase today. It is projected that 2.7 million jobs will be affected by the increase.

✏️ What employers need to do....

To avoid legal action for unpaid wages, employers must ensure that employees are being paid their entitlements. Managers should:

✔️ Review modern award and enterprise agreements.
✔️ Check carefully workers' classifications and entitlements;
✔️ Check pay slips;
✔️Review worker check-in logs to see hours worked and breaks;
✔️ Ensure that every worker has received their Fair Work Information Statement (it should be provided at the start of employment); and
✔️Check position descriptions and duties statements- If the worker's PD is at a higher level then a higher modern award classification may apply and if so, more money will need to be paid.

✏️Why it is important to get right:

✔️The Fair Work Ombudsman (FWO) investigates underpayments of wages. The FWO can investigate and prosecute in Court underpayments.
✔️ People deserve to be paid fairly for their work.

FAQ:
Q: If I pay a set salary, do I need to worry about the Modern Award classifications?

A: The total amount paid to the worker needs to be higher than their entitlements under the Modern Award. This is why it is important to know what the minimum threshold is. A common trap is not calculating overtime.

Q: The employment contract says that the person will work "reasonable additional hours".
The total payment (whether salary or minimum entitlements) need to include payment over overtime for workers who are covered by a Modern Award.
