▶️ In most cases, you have 12 months to lodge a TAC claim - either from the date of the accident, or from when your injury first becomes apparent.

While that might sound like plenty of time, it’s always best to act sooner rather than later. Getting things underway early can make the process smoother.

If you’re worried you may have missed the deadline, don’t assume it’s too late. There are some circumstances where late claims may still be accepted.

If you’ve been injured at work, knowing where to start can make all the difference.

The first step is to report the injury to your employer and complete a WorkCover claim form.

You’ll also need your doctor to provide a WorkCover medical certificate, known as a “Certificate of Capacity.”

From there, the process can start to feel a bit more complex - and that’s where legal support makes the biggest difference.

Meet one of our paralegals, Brigit Nugent 🧡

Brigit brings a seriously impressive mix of experience to the Polaris team!

With a Bachelor of Science in Nutrition Science and Biotechnology, she’s now completing a Juris Doctor alongside postgraduate studies in food science at the University of Melbourne.

She’s also passionate about making information easy to understand, regularly running nutrition workshops for people from a range of language backgrounds.

Before joining Polaris, Brigit held academic roles at both the University of Melbourne and RMIT.

Outside of work, she’s often out trail running, catching up with friends, enjoying great food, or growing her ever-expanding cacti collection! 🌵

Some cases stay with you long after they’re finished.

Our recent County Court win - securing $836,228 in damages (or $929,688 with interest) after a 16-day medical negligence trial - was one of those.

In this case, a young man living with a genetic disability lost his mother following post-surgery complications. Negligence was strongly contested by the other side - but ultimately proven at trial by Polaris.

For Polaris Director and Principal, Alice Robinson, it was deeply personal.

Making this area of law more accessible matters to Alice, shaped in part by growing up alongside a family member with a profound disability.

If you’ve been injured at work in Victoria, you may be able to bring a common law claim - but only if your injury meets the legal threshold of being “serious”, and there is fault on the part of another party.

So, what does “serious” actually mean?

In simple terms, a serious injury is one that continues to affect your day-to-day life. If you’ve made a full recovery and returned to how things were before, it’s unlikely to qualify.

If your injury is assessed as serious, you’ll be given a certificate that allows you to move forward with a claim. From there, negligence still needs to be proven.

A huge congratulations to Principal and Director Alice Robinson on an outstanding result in the County Court.

After a 16-day medical negligence trial, Polaris secured a jury verdict of $836,228 in damages for one of our most vulnerable clients, bringing the total outcome to $929,688 with interest.

This was a hard-fought matter, and the result means our client now has greater security and support for the future.
