𝗖𝗼𝘂𝗹𝗱 𝘆𝗼𝘂𝗿 𝗧𝗿𝗮𝗶𝗻𝗶𝗻𝗴 𝘃𝗶𝘀𝗮 (𝘀𝘂𝗯𝗰𝗹𝗮𝘀𝘀 𝟰𝟬𝟳) 𝗮𝗿𝗿𝗮𝗻𝗴𝗲𝗺𝗲𝗻𝘁𝘀 𝘄𝗶𝘁𝗵𝘀𝘁𝗮𝗻𝗱 𝗮 𝗰𝗼𝗺𝗽𝗹𝗶𝗮𝗻𝗰𝗲 𝗶𝗻𝘀𝗽𝗲𝗰𝘁𝗶𝗼𝗻?

A new national compliance operation led by the Australian Border Force has already resulted in more than 100 workplace inspections across six states and territories, with further inspections planned nationwide. Early findings identified concerns, including inadequate training plans and trainees undertaking duties unrelated to approved training activities.

For employers sponsoring trainees, the operation highlights the importance of ensuring training arrangements are genuine, properly documented and aligned with approved program objectives.

𝗪𝗵𝘆 𝘁𝗵𝗶𝘀 𝗺𝗮𝘁𝘁𝗲𝗿𝘀 𝗳𝗼𝗿 𝗲𝗺𝗽𝗹𝗼𝘆𝗲𝗿𝘀:
• More than 100 workplace inspections have already taken place
• Training plans and workplace activities may be reviewed
• Approximately 55% of subclass 407 applications were refused or withdrawn between 1 July 2025 and 30 April 2026
• Sponsors may face sanctions, penalties or sponsorship restrictions where non-compliance is identified
• Training arrangements should support genuine skills development outcomes

As compliance activity increases, employers should review their current training arrangements and sponsorship practices.

𝗠𝗮𝗷𝗼𝗿 𝗰𝗵𝗮𝗻𝗴𝗲 𝘁𝗼 𝘀𝘁𝘂𝗱𝗲𝗻𝘁 𝘃𝗶𝘀𝗮 𝗿𝗲𝗳𝘂𝘀𝗮𝗹 𝗮𝗽𝗽𝗲𝗮𝗹𝘀 𝗻𝗼𝘄 𝗶𝗻 𝗲𝗳𝗳𝗲𝗰𝘁

As of June 2026, most student visa refusal reviews are now being decided by the Administrative Review Tribunal (ART) on the papers rather than through a hearing.

This means many applicants will no longer have the opportunity to explain their circumstances directly to the Tribunal and must instead rely on written submissions and supporting evidence.

𝗞𝗲𝘆 𝗰𝗵𝗮𝗻𝗴𝗲𝘀:
• Most student visa refusal reviews will be paper-based
• Updated enrolment evidence may be required during the review process
• Hearings will still apply for certain character, health and integrity-related refusals
• New response deadlines apply to ART information requests
• Some existing review applications may also be affected

The move is expected to streamline application processing, improve visibility for applicants, and reduce delays linked to paper-based lodgements.

Temporary Parent visa subclasses 173 and 884 must still be lodged by paper application.

Families and sponsors should ensure they are using the correct lodgement method, as incorrect submissions may lead to delays or applications not being accepted.

The Administrative Review Tribunal and Other Legislation Amendment Act 2026 expands the ART’s ability to determine certain temporary visa review matters “on the papers” without conducting an oral hearing.

The amendments apply to certain temporary visa review matters that may be prescribed under the Migration Regulations.

While no temporary visa subclasses have yet been prescribed under the Migration Regulations, the legislative framework allowing these paper-based review processes has now commenced.

𝗧𝗵𝗲 𝗰𝗵𝗮𝗻𝗴𝗲𝘀 𝗱𝗼 𝗻𝗼𝘁 𝗮𝗽𝗽𝗹𝘆 𝘁𝗼:
• Permanent visa review matters
• Protection visa applications

𝗙𝗼𝗿 𝗮𝗽𝗽𝗹𝗶𝗰𝗮𝗻𝘁𝘀 𝗮𝗻𝗱 𝘀𝗽𝗼𝗻𝘀𝗼𝗿𝘀, 𝘁𝗵𝗲 𝗿𝗲𝗳𝗼𝗿𝗺𝘀 𝗺𝗮𝘆 𝗶𝗻𝗰𝗿𝗲𝗮𝘀𝗲 𝘁𝗵𝗲 𝗶𝗺𝗽𝗼𝗿𝘁𝗮𝗻𝗰𝗲 𝗼𝗳:
• Detailed written submissions
• Organised supporting evidence
• Strong legal arguments
