Can criminal charges be withdrawn in Victoria?

Yes. However, once criminal charges have been filed, it is the prosecution — rather than the complainant — that decides whether the charges continue.

Charges may be withdrawn in certain circumstances, including where there is insufficient evidence, a key witness becomes unavailable, new evidence affects the prosecution case, or as part of negotiations about how a matter is resolved.

A withdrawn charge is also different from being found not guilty.

A review should reflect a genuine experience.

The ACCC says reviews can be misleading when they are created by someone who hasn’t actually used the product or service.

Under Australian Consumer Law, false or misleading representations that present themselves as testimonials can be unlawful in the circumstances covered by the law.

Google also requires reviews to be based on a genuine experience.

So if you didn’t use the business, don’t pretend you did.
