From 15 December 2021, fully vaccinated eligible visa holders will be able to travel to Australia without the requirement to apply for a travel exemption.

The Australian Government has added some visa subclasses to the list, which still include international students and skilled workers. To be considered as an eligible visa holder, you must hold one of the following visas: Subclasses 163, 173, 200, 201, 202, 203, 204, 300, 400, 402, 403, 405, 407, 408, 410, 417, 449, 457, 461, 462, 476, 482, 485, 487, 489, 491, 494, 500, 560, 571, 572, 573, 574, 575, 580, 590, 785, 786, 790, 870, 884, 988. Applicants who have applied for one of these visas, but have not yet been granted one, are not considered eligible visa holders.

Invitation rounds for the Skilled Independent SC 189 and Skilled Workers Regional (Provisional) SC 491 visas are expected to take place every three months, however, the dates are subject to change.
Information on the latest SkillSelect invitation round on 29 October 2021 for subclass 189 and subclass 491 have been released. There are 200 invitations issued for Skilled Independent SC 189 and another 200 for Skilled Workers Regional (Provisional) SC 491, with minimum score points of 90 and 80 respectively.

VISA CHANGES The Minister is currently planning to make some changes to the subclass 485 visa provisions.

- The new visa setting allows longer SC 485 visa duration from two to three years for international students pursuing Masters through coursework. Vocational Education and Training (VET) sector graduates will also receive a two-year Temporary Graduate visa.
- International students and temporary graduates who spent time offshore studying online will count towards qualifying for a temporary graduate visa.
- Current and former subclass 485 holders who have been unable to travel to Australia due to border restrictions may be able to apply for a replacement visa.

Australia will pause border re-opening for international skilled and student cohorts, as well as humanitarian, working holidaymaker and provisional family visa holders for about 2 weeks, starting from tomorrow, 1 December 2021 until 15 December 2021.

During the temporary border closure, The Australian Government will gather information to better understand the Omicron variant, including the efficacy of the vaccine, the range of illness, symptoms, and also the level of transmission.

The Government has implemented new measures for travellers entering Australia to prevent the spread of the new COVID-19 version, known as ‘Omicron’. For the next two weeks, all flights to Australia from South Africa, Namibia, Zimbabwe, Botswana, Lesotho, Eswatini, the Seychelles, Malawi, and Mozambique are suspended. Omicron has been detected in South Africa, Botswana, Hong Kong, Israel, Belgium, and the United Kingdom.

In response to this situation, The States and territories in Australia implement new border security procedures, as summarised below:

• Australian Capital Territory
Fully vaccinated travellers need to quarantine until 11.59pm, 30 November 2021. Unvaccinated travellers must quarantine for 14 days in a hotel.

• South Australia
International travellers and people coming from high-risk locations within Australia must quarantine for 14 days. Those coming from low/moderate risk areas within Australia need to show a negative covid test proof for 72 hours before arrival.

• Victoria
All international travellers need to get tested and isolate for 72 hours.

• NSW
All international travellers need to get tested and isolate for 72 hours.

• Western Australia
No changes to the previous 14-days hotel quarantine for all overseas returned travellers. Tightened border with SA, anyone from SA must also self-isolate for 14 days.

• Queensland
All international arrivals to do hotel quarantine and domestic arrivals to do home quarantine.

• Northern Territory
No action taken yet, only covid-positive tested will need to go quarantine.

The World Health Organization has declared the Omicron strain, to be a variant of concern. It was first detected in southern African countries and has a high number of mutations within its spike protein. Those who are not yet vaccinated should make an appointment and those who were already fully vaccinated for more than six months ago and haven’t yet had a booster dose, should consider making a booking for the booster now.

VISA CHANGES Temporary Graduate (subclass 485) visa holders who are stuck overseas and unable to enter Australia because of the border restrictions will be able to apply for a replacement visa. A measure is soon-to-be-released by the Australian Government which supports current and former Temporary Graduate (subclass 485) visa holders whose visas expired on or after 1 February 2020 to be able to re-apply for a new subclass 485 visa with the same duration as their original visa. Fully vaccinated eligible Australian visa holders will be allowed to travel to Australia without the requirement for travel exemptions starting from 1 December 2021.

Eligible visa holders include international students and skilled workers, are people who hold the following visas: Subclasses 200, 201, 202, 203, 204, 300, 400, 403, 407, 408, 417, 449, 457, 461, 462, 476, 482, 485, 489, 491, 494, 500, 580, 590, 785, 790, 870, 988.

The Australian Travel declarations and pre-flight COVID testing will still apply to those who plan to enter Australia. Please check covid.19.hommeaffairs.gov.au for further details on the steps required for arrival in Australia. Some states in Australia still require travellers to do quarantine after arriving in Australia. Please check australia.gov.au for further information.

In some cases, these gaps are filled through migration and the Workforce Skills Pathway (WSP) introduced by the Victorian Government is an initiative to address state-wide or region-wide skill gap and may have its own unique selection criteria. Current Workforce Skills Pathways include:
1. Hospitality
Applicable to those who are living and working in Victoria as a cook or chef.

2. Early Childhood Educators
Applicable to those who are living and working in Victoria as an Early Childhood (Pre-primary School) Teacher
Applicants under the WSP are exempted from the requirement to work in a Victorian target sector using STEMM skills to be selected for the Victoria Skill Nomination Programs.

- There will be no nominations for the Investor (Subclass 188B) and Significant Investor Streams (Subclass 188C) this year.
- Prospective applicants must submit a Registration of Interest (ROI) detailing their business or entrepreneurial proposal and skills prior to invitation for nomination being sent by the Tasmanian government to those with the strongest proposal.

The section 48 bar applies to applicants who have had a visa refused or cancelled since their last entry into Australia. The Minister for Immigration, Migrant Services and Multicultural affairs made amendments to the Migration Regulations 1994. Starting from 13 November 2021, a S48 Bar waiver is available for skilled visa applicants for subclasses: sc190, sc491 and sc494. This means that Section 48 barred applicants can apply for sc190, sc491 and sc494 visas Onshore from the mentioned date.
