What Do You Mean the Property Is Not Ours? We Paid a Deposit!

You've found the perfect property.
✅ Your offer is accepted.�✅ You've paid a deposit.�
Then the real estate agent calls:
"Unfortunately, the seller has decided to accept another offer."

How can that happen?

In New South Wales, many buyers are surprised to learn that paying a deposit does not necessarily mean you have secured the property.

Until contracts are exchanged, either party can generally walk away from the deal.

This means that even if:
• Your offer has been accepted;�• You have paid a holding deposit; or�• You have received a copy of the contract;
the seller may still be able to sell the property to someone else.

This is sometimes referred to as being "gazumped" and it can leave buyers disappointed and out of pocket after spending money on pest reports, building inspections, valuations and legal advice.

The key milestone is exchange of contracts, not payment of a deposit.

Before you commit money or make plans based on a property purchase, it is important to understand exactly where you stand legally.
