Renovating a Family Property? Get Advice First! 🛠️

One recent dispute involved family members contributing substantial labour, money and improvements to a property.

When ownership issues arose later, the court had to determine whether those contributions created a legal entitlement.

The outcome may not have reflected everyone's expectations. If you're:
🏠 Renovating a family property
🏠Contributing funds to someone else's home
🏠Improving a property you don't own
obtain legal advice before making significant contributions.

A conversation is good. A written agreement is better.

You’ve updated your bank account password. You’ve updated your phone. You’ve even updated your streaming subscriptions. 📱🔐

But when was the last time you updated your Will?

Life constantly changing, whether it be relationships, property, children or finances. Your wishes can all change too. Your Will should keep up with your changing circumstances.

📩 If it’s been a while, it might be time for an update.

The Bank of Mum and Dad Needs Protection Too 💵

Many parents are willing to help their children get into the property market.

However, when relationships change, memories fade and expectations differ, family assistance can quickly become a legal dispute.

Recent court decisions show that judges are often left to reconstruct conversations that occurred years earlier.

The result? Uncertainty. Stress. Significant legal costs.

The best protection is simple:
✅ Written agreements
✅ Independent legal advice
✅Clear records of contributions

Good family relationships deserve good legal documentation.

Many business owners spend years building a successful business, but few stop to consider what would happen if they were suddenly unable to manage it 💭

If you were to pass away, lose capacity, or become seriously ill, could your business continue to operate smoothly? Would your family, business partners, or staff know what to do next?

Without the right legal planning in place, your business could face:
🔹Operational disruption
🔹 Frozen bank accounts or key decision-making delays
🔹 Ownership disputes
🔹 Financial uncertainty for your family and employees
🔹 Significant impacts on business value

A well-structured succession plan, including a valid Will, Enduring Power of Attorney, shareholder or partnership agreements, and business succession arrangements, can help protect both your business and your loved ones.

‼️ The best time to plan is before the unexpected happens.

At Tranter Lawyers, we help business owners put the right legal safeguards in place to ensure their business can continue with certainty when life takes an unexpected turn 💙

Last week, our team proudly wore denim in support of Jeans for Genes Day 💙👖

We’re so proud to have raised an incredible $440 in just one day through our fundraiser! 🧁💙

Together, we helped support the Children’s Medical Research Institute and its vital work funding research into genetic diseases affecting children across Australia.

A huge thank you to everyone who baked, donated and got involved. Your generosity helped make our Jeans for Genes Day a little more special — and a whole lot sweeter! 💙

Do You Have an Offset Account? 💰

It might be time to check that it’s actually working.

Recent findings by ASIC have revealed that some Australian banks have incorrectly set up or managed mortgage offset accounts, resulting in customers paying millions of dollars in extra interest. More than $55 million has already been repaid to affected borrowers, with further compensation expected.

An offset account is designed to reduce the amount of interest you pay on your home loan. However, if it hasn’t been correctly linked to your loan—or if changes such as refinancing have affected the link—you could be paying more than you should without even knowing it 📈

Take a few minutes to check:✅ Is your offset account linked to the correct home loan?✅ Has it remained linked after refinancing or changing loan products?✅ Do your interest charges appear consistent with your offset balance?

If something doesn’t seem right, contact your lender promptly. If the issue isn’t resolved, you may have options to escalate the matter and seek compensation.

While it's common to include your funeral wishes in your Will, many people don't realise that those wishes aren't legally binding and may not be read until after the funeral has already taken place 🕊️

If you have specific preferences for your funeral, the best way to help ensure they're known is to discuss them with your loved ones and record them in a separate, easily accessible document 📑

Planning ahead can provide clarity and peace of mind for those you leave behind.

If you'd like advice on estate planning or ensuring your wishes are communicated as clearly as possible, the team at Tranter Lawyers is here to help 💙
