Before signing a commercial lease, read this!

A commercial lease is one of the most significant legal commitments a business can make. Unlike a residential lease, commercial leases are heavily negotiated documents that can lock your business into obligations for years. And unlike a residential tenant, you have far less legislative protection if something goes wrong.

Before you sign, you need to understand exactly what you are agreeing to. Rent increases, outgoings, permitted use clauses, make good obligations, and personal guarantees are just some of the terms that can have a serious financial impact on your business if they are not properly reviewed beforehand.

You need this in writing!

A verbal agreement is still a legal agreement. But proving what was actually said, agreed to, and understood by both parties is another matter entirely.

Handshake deals and informal arrangements work fine until they don’t. When a dispute arises, the first thing any lawyer will ask for is the written agreement. If there isn’t one, you’re left relying on memory, text messages, and emails to piece together what was agreed. That is not a position you want to be in.

It doesn’t matter how well you know the other person or how straightforward the arrangement seems. If it’s important to your business, get it in writing.
