Today we appeared at Nowra in the Local Court for a sentence matter where we ultimately persuaded the Court to exercise its discretion not to record a conviction against our client.

The Nowra Court building sits as both the Local and District Court and hears a wide range of matters from minor traffic matters and fine elections, to serious violence and sexual assaults. The current building (pictured first and - today, regrettably undergoing renovation works - second) was designed by government architect, Walter Liberty Vernon an opened in 1896, replacing the older lock-up/court house (pictured third, just next door) which served from 1861 and later become the local police sergeant’s residence.

Today our Principal, Gerard Mitchell, appeared at Deniliquin Local Court to finalise a serious matter in which the offending arose out of a unique set of circumstance the explanation of which required expert advocacy. As a result of Gerard’s efforts and careful case management of the matter - involving collaboration with several experts - our client avoided a custodial sentence.

Deniliquin Local Court has been described by locals as ‘the grandest building in Deniliquin’. The site was proclaimed as a Court site in 1846 while proceedings were run out of hotels until the construction of a (temporary) building. The current building - another design of James Barnet and the NSW Colonial Architects Office - was completed in 1885 but mired in controversy relating to its location and fitness for purpose (taking into consideration the climate in the area), not officially opening and being used as a Court until November 1892.

🎄12 Days of Double Demerits This Christmas in NSW🎄
If you’re driving this festive season, here’s an important reminder:

NSW Police are enforcing DOUBLE DEMERIT POINTS for 12 days over the Christmas and New Year period.

📅 Double demerits apply from 24 December to 4 January.

During this time, offences including:
• Speeding
• Mobile phone use
• Not wearing a seatbelt
• Motorcycle helmet offences
➡ will attract double the usual demerit points.

For learner and provisional drivers especially, it doesn’t take much to lose your licence — and even full licence holders can reach their limit faster than expected

📍 Whether you’re heading to Christmas lunches, school holiday activities or travelling out of Sydney, slow down, put the phone away and arrive safely.

Today we appeared at Dubbo Local Court for a hearing that was adjourned. As a result of that adjournment, we were successful in a costs application against police for our client’s costs thrown away, being a sum of more than $13,000.

Dubbo has an interesting history in terms of its courthouses. The current one, pictured here, is located on Brisbane street and was designed in the 1880’s by (you guessed it) James Barnet. It was opened in 1889 and has been in operation now for 137 years!

Prior to the current building, the court grew out of the old Dubbo gaol lockup in 1847, which was later used as a drill hall for the local regiment.

The court at Dubbo comprises both the Local Court and the District Court of NSW and hears a diverse range of matters.

On 8 October 2025, we received judgment in an appeal matter in the NSW Court of Criminal Appeal. The original trial related to alleged involvement in three separate drug importation matters, totalling more than a ton of border-controlled drugs.
Despite our belief that there had been a miscarriage of justice (we appeared in the initial trial), subsequent lawyers consulted by our client disagreed, and were unable to ground an appeal.
With the guidance and support of family, our client ultimately returned to us to help him.
After much work, and almost 6 years after his original convictions, the Court of Criminal Appeal ultimately upheld the appeal, setting aside our client’s convictions, along with a 30-year sentence of imprisonment.

This is a massive victory for the team at Mitchell & Co Lawyers and one of which we are very proud!

Today we travelled to historic Young and appeared at Young Local Court, dismissing 3 separate sets of charge matters under mental health legislation.

Young is an excellent example of an early colonial town, being settled in 1826. It enjoyed a boom in the 1860’s after the discovery of gold in the nearby town of Grenfell and surrounds, which brought other troubles with it after riots broke out between rival factions of miners and prospectors.

Pictured here is one Young’s two court buildings. This building was constructed in 1928-1929 and has operated as the Local Court since that time. The building replaced the earlier ‘great’ courthouse, that has now become a part of the high school. The ‘great’ courthouse was another of James Barnet’s designs, opening in 1886. The current local court was one built not long after federation, with the first being Manly Local Court in 1908.

This week, our Principal, Gerard Mitchell is appearing in a jury trial at the Goulburn District Court, pictured here.

The Goulburn District Court is a beautiful building, packed with history, as is the surrounding area.

The first quarter sessions in the colony were held in 1841 at Berrima Court House (a couple of towns away), which served the greater region at that time, with the first trial by jury for the colony in 1843.

In 1850 the Court was moved from Berrima to Goulburn which was later formally amalgamated into what is now known as the District Court of NSW.

The current building was constructed from 1885-1887 and was designed by James Barnet (who followers of our page might recognise as having designed MANY other Court buildings of that age)

Today (due to the chaos affecting the Downing Centre Court Complex) our Lawyer Ian appeared at Central Local Court, which has been effectively closed for renovations and repairs for a significant period of time.

The Central Court building was completed in 1892 and was another of the civic buildings designed by James Barnet.

NSW double demerits reminder

We advise motorists that double demerits are in place in NSW and the ACT for five consecutive days over the 2025 King’s Birthday long weekend, from Friday 6 June to Monday 9 June 2025, inclusive.

Please drive safely and take extra care on the roads to protect yourself, your loved ones and all road users.
Drivers are reminded additional penalties can apply for certain offences committed in school zones.

What offences attract double demerits?
During double demerit periods, double demerit points apply for speeding, illegal use of mobile phones, not wearing a seat belt and riding without a motorcycle helmet.

Keep in mind that Mobile Phone Detection Cameras are active in NSW and the ACT and drivers caught using their phones during a double demerit period will be hit with a $410 fine ($544 in a school zone) and 10 demerits.
Certain driving and parking offences attract an additional demerit point if committed in an operating school zone. Remember to always drive with care and attention through school zones.

This morning we appeared at Wollongong Local Court in the early stages of proceedings in relation to a charge of murder that will require careful consideration and navigation to ensure the best outcome for our client.

The Wollongong Court House upgrade was completed in 2016 for a cost of $17.5 million. It comprises both the Local and District Courts of NSW and 7 Court rooms.

The original (‘old’) Wollongong Courthouse, located not too far away, is the oldest public building in Wollongong - built in 1858 and itself replacing the earlier iteration, being a makeshift room off the military barracks established in 1832.
