Maxwell Parker Dispute Resolution is an independent, private Dispute Resolution practice, providing facilitative mediation services to a wide range of individuals, families and businesses that are in dispute.

BENEFITS OF MEDIATION

Mediation is a flexible, time and cost effective way for parties to resolve disputes.

Unlike other judicial avenues (ie Litigation, Court proceedings), mediation provides a private and confidential setting for parties to work through their dispute. Parties to the dispute are in control of the decisions they make.

The role of the mediator includes ensuring discussions are balanced and fair, that the underlying needs and concerns of the parties are explored, that options are explored and are realistic, and to help parties formulate an agreement - should an agreement be forthcoming.

Matthew Maxwell, Principal of Maxwell Parker Dispute Resolution, is a nationally accredited mediator (NMAS), registered Family Dispute Resolution Practitioner (FDRP) and Professional Member of the Resolution Institute (PRIMed). Matthew can assist in a wide range of disputes. These include, but not limited to:

OUTCOMES OF MEDIATION

Outcomes of a mediation vary and can range from verbal agreements, to informal written plans, to agreements that may be formalised by a lawyer, to agreements that can be legally enforceable. People attending mediation should always seek independent legal advice prior to mediation, in order to best understand their legal rights and options.

Depending on the type and nature of the dispute, parties may wish to have their lawyers present. Unlike some dispute resolution providers, we are more than happy to allow clients have their lawyers attend (or other support person) however this is subject to the consent of the other person/s involved. Typically, if one party is represented by a lawyer, it is preferred that both sides are represented. Having lawyers attend a full mediation can result in increased costs, so we encourage you to discuss your situation and requirements with us, as we can assist work through a variety of options.
