A recent NSW decision highlights the critical importance of managing psychosocial risks during performance management.

For the first time, a Commonwealth employer has been convicted for failing to minimise these risks—underscoring the need for proper supervisor training, regular consultation with employees, and processes that balance performance with wellbeing.

Now is the time for employers to review their performance management and WHS frameworks to ensure mental health risks are adequately addressed.
