One of the most ridiculous pieces of legislation when it comes to purchasing property in NSW is the requirement for the buyer to bear the risk, logistics, and cost of making a swimming pool compliant within 90 days of taking possession (settlement), with zero onus placed on the seller to make it compliant for sale.

In practical terms, this means that the actual current owner has been living with a non-compliant pool, and therefore a technical safety issue, for potentially years. This clearly demonstrates that safety with regard to swimming pools in NSW is purely a façade. If the government was serious about safety, they would mandate a regular compliance schedule via council inspections, as with other states, and regardless of who owned it at any given time. Additionally, they would ensure that to sell any property with a swimming pool, a certificate of compliance must be attached to the purchase contract.

Above, you can see a redacted inspection report from the City of Stirling, an LGA in Western Australia confirming swimming pool compliance after a routine inspection. Western Australia mandates a maximum 4 year inspection cycle for swimming pools where the owner is required to pass compliance checks to ensure ongoing safety of the swimming pool and therefore the occupants.

Despite our office having met with previous local MPs in the past about this kink in the legislation from both a logical and safety perspective, nothing has changed yet. Ultimately this places a cost, risk and logistical burden on the wrong party at the wrong time, all whilst reducing safety and we strongly believe it should be changed.
