When should I make a Will?

Planning your estate can help to reduce stress, disputes and legal issues for your loved ones after you pass away.
If you are:
• over 18 years of age.
• have children or other dependents
• own assets of value including a home, business, savings or investments,

then you should have a valid Will in place so that your wishes are followed and to provide peace of mind for your loved ones.
If you already have a Will, you should consider reviewing it every 3-5 years or after any major life changes, including marriage or divorce, to ensure that it reflects your wishes and current circumstances.
If you die without a Will, your estate is distributed according to the applicable State or Territory legislation, and your personal wishes won’t be considered.

Did you know that Mediation or Court are not the only options to resolve a family law dispute? Many family lawyers work together to help their clients reach an agreement. This could be from simply picking up the phone and having a conversation to narrow issues to having a ‘round table’ discussion where the lawyers with their clients sit together to work through the dispute and work on a resolution.

In April we ran our 3rd CPD By The Sea event in Phuket, Thailand. Our event focused on wellbeing for lawyers particularly those practising family law. This area of law is emotional, challenging and quite frankly exhausting at times. The rates of burnout amongst family lawyers are at an extreme high. Our event brings lawyers together to focus on collaboration and a ‘reset’ so they can continue to bring high quality service to those clients who need it most.

The Federal Budget promised to look after those doing it tough but for Australians who need legal help to escape family violence, protect their children, or defend their rights against government decisions, justice remains out of reach.

The chronic underfunding of legal assistance services has been left unaddressed. As a result, from 1 July 2026, Legal Aid NSW will be forced to turn away anyone seeking help with parenting, property or enforcement proceedings, unless they are a victim of domestic and family violence or an Aboriginal person. Independent Children’s Lawyers will now also not receive funding to appear at a final hearing.

This news will increase delays, inefficiencies and miscarriages of justice. Parties with access to funds will be clearly at an advantage.
