Mother awarded over $613,000 in landmark compensation claim against K-Mart

In September 2018 Rita Marmara was shopping with her family at K-Mart’s Woy Woy store on the NSW Central Coast, when she was struck by a boxed mountain bike in the self-checkout section of the store.

The evidence was that another customer balanced two large boxed mountain bikes on top of a shopping trolley, when one fell off and struck Ms Marmara’s back causing significant spinal injuries.

Duty of care, foreseeability & whether
the defendant failed to take reasonable precautions to alleviate the risk of harm so as to breach any duty of care owed to Ms Marmara were very live issues for determination by the Court.

So too was the nature & extent of Ms Marmara’s injuries which the Defendant sought to minimize.

The final judgement for compensation in favour of Ms Marmara exceeded $613,000. A fantastic outcome for serious injuries sustained by Ms Marmara because of the Defendant’s negligence.
