Not every poor medical outcome counts as negligence, but some do, and it's important to know the difference.

Under NSW law, a medical negligence claim needs three things to line up: a duty of care, a breach of that duty (care falling below what a reasonable specialist would provide), and a direct causal link between that breach and the injury.

Common examples include surgical errors, misdiagnosis or delayed diagnosis, medication mistakes, and failures to warn patients of risks.

If you believe a mistake affected your care, you generally have three years from when you discovered (or should have discovered) the injury and its cause to bring a claim.

Can someone who unlawfully kills a person still inherit from them?

In NSW, the answer is no — thanks to the forfeiture rule.

Our Associate Director, Michelle Bromfield breaks down how this rule operates: it blocks Will gifts, intestate succession, joint tenancy survivorship, and even super or life insurance proceeds from going to someone who unlawfully killed the deceased.

For murder, the rule applies absolutely. For manslaughter, courts have discretion under the Forfeiture Act 1995 (NSW) to modify it based on the circumstances.

Michelle's key advice for executors: if an estate is touched by a suspected unlawful killing, pause distributions and get advice early. Don't wait for criminal proceedings to conclude.

Surrogacy arrangements rely on trust but what happens legally if a surrogate changes their mind?

In a recent decision, Taggart & Gowden [2026], the Family Court grappled with exactly this. This article looks at what the court could and couldn't decide on an interim basis including why parentage declarations can't be made as temporary orders, and how the court weighed the child's welfare, identity and cultural connection in deciding interim care.

It is a reminder of just how important clear legal advice is before entering a surrogacy arrangement... not just after something goes wrong.
