As the Gold Coast Suns prepare for their inaugural AFL finals series, it appears that they are not the only AFL talent on the Gold Coast. As per usual, Partner Joe Welch is credited in the results, despite having minimal involvement in the outcome. Qld Sunset Date Laws Have Not Changed for Strata Off the Plan Contracts

There seems to be a bit of confusion about whether the laws that affect Sunset Dates in Queensland off the plan contracts, have changed.

A few clients and even other lawyers, didn't realize the subtle change to be made by the passing of the Body Corporate and Community Management and Other Legislation Amendment Bill 2023.

For starters the Bill has been passed by the Qld Parliament but it hasn't received assent, so technically its not in force as at 21 November 2023.

Secondly the amendments ONLY affect Sunset Dates for land that is NOT in a community titles scheme or under the Building Units and Group Titles Act or the Southbank Corporation Act.

So basically it doesn't apply to the purchase of strata units. Also it doesn't apply to land that is in a body corporate structure like Sanctuary Cove Resort, Hope Island Resort, Royal Pines Resort and Calypso Bay.

It applies to the sale of freehold land in Queensland (not in a body corporate structure).

Rather than extend this post, I will do another post about the effect of the amendments.

NEW QLD BODY CORPORATE LAW BILL - 75% OF LOT OWNERS CAN REDEVELOP FOR "ECONOMIC REASONS"

On 24 August 2023 the Queensland Attorney General introduced a bill to change body corporate laws. To be clear, this bill doesn't change the law... yet. It still has to go through a consultation process and there is scope for amendments.

However it does give a very good indication how the law could end up.

There has been plenty of media and real estate industry speculation about how the law will be changed so that 75% of lot owners can force the others to sell out to a developer. That is NOT what the new draft law says. If there are "economic reasons" and the body corporate comes up with a "termination plan" then yes, the new draft law will allow 75% of lot owners to force a sale.

The bottom line is that you cannot simply terminate a scheme if you have 75% or more of lot owners voting in favour of it. You need to have a termination plan and generally it needs to be for economic reasons such as the body corporate is facing excessive costs to maintain repair or rectify buildings. In these cases, selling the scheme land to a developer for termination and redevelopment can make more economic sense than requiring lot owners to pay large contributions to enable the body corporate to meet its statutory maintenance obligations.

It is with great sadness that the partners and staff of Hickey Lawyers share the news of the passing of Geoff Thams. Geoff was not just a partner at Hickey Lawyers; he was a mentor, a friend, and a guiding light to all who had the privilege of knowing him.

Although Geoff had retired some time ago many at Hickey Lawyers remember him fondly.

He had a warm smile, a contagious laugh, and an empathetic nature that made everyone feel valued and heard. His door was always open, and his wisdom and guidance were sought after by many.

During this difficult time, our thoughts and deepest sympathies go out to Julie, Geoff's wife and of course the rest of the Thams family, friends, and loved ones.
