Seventeen CCTV cameras and a trip to the NSW Supreme Court...over a driveway. This is how neighbourly disputes can (and do) escalate!

In Au v Berlach [2022] NSWSC 81, the Berlachs had a registered easement across their neighbour's land, as it was their only way in and out of their property. When the neighbourly relationship soured, Dr Au installed an elaborate surveillance system and many 'rules', but the court found he had no right to do so.

The lesson from this case is that a properly registered and clearly worded easement gives you the legal standing to protect your rights when things go sideways.

If you're buying a property with an easement, or your land is subject to one, understanding what it says and what it means could save you a lot more than legal fees.

When a relationship ends, most people think about the house, the savings, the car - but not super.

Superannuation is treated as property under the Family Law Act, which means it's included in the pool of assets when a couple separates. It doesn't split automatically, you have to actively flag it as part of the property settlement process. If you don't, you could walk away having left one of your most significant assets on the table.

This matters especially for anyone who stepped back from work to raise children. While one partner was building their super balance, the other was making that possible. The law recognises that contribution, but only if you know to ask.

Too busy, too young, not sure where to start, or they have a vague sense that it can wait until things are more settled.

A lot of people believe that if you haven't been together for two years, you have no property rights when a de facto relationship ends.

That's not quite right.

Two years of living together is generally the threshold under the Family Law Act. But if there are children from the relationship, or if one person made significant financial or non-financial contributions, the Court can still make property orders even if the two year mark wasn't reached.
