Conventional wisdom suggests that regulation stifles innovation. The narrative is familiar: compliance requirements drain resources, create bureaucratic friction, and constrain creative problem-solving. Yet the reality is far more nuanced. Throughout history, some of the most transformative innovations have emerged not despite regulatory constraints, but because of them.

Congratulations to Photon Energy Group on their successful application for an electricity retailer authorisation.

These applications are very complex and not every business should apply. Despite this, this represents our 3rd approval (including one in Victoria) this month. If you would like to discuss energy retail authorisation and licensing or compliance, please get in touch.

The AER has published the National Electricity Market (NEM) Readiness Guide and checklist. The guide updates and replaces the AER’s Summer Readiness Compliance Bulletin and checklist.

The guide recognises the criticality of participants maintaining a focus on compliance with their obligations all year round so they are prepared for, and can respond to, challenges as they arise.

The guide is accompanied by a checklist to help participants assess their readiness.

The NT Utilities Commission has published its Annual Compliance Monitoring Report for 2021-2022. The report examines compliance reports lodged by energy licensees.

A material breach was reported by Jacana Energy who in February, advised the commission of the breach of cl 10 of the Energy Retail Supply Code with a customer who required life support equipment being disconnected despite advising of their need for life support equipment at the property. Clearly, this was a very serious and potentially deadly breach.

No harm was caused to the customer and electricity supply was quickly reconnected. On reviewing the incident, Jacana identified that another customer’s premises (who also required life support equipment) had come close to disconnection- but the disconnection did not proceed as the network provider had the premises as registered.

The report is a valuable resource for energy licensees, as it provides an overview of compliance levels and highlights any areas of non-compliance.

The Commission will continue to monitor compliance with the energy codes and standards in the coming year.
