Changes to land tax for Victorian properties:

From January 1 2022, the following changes have come into effect to land tax rates:

• An increase to the tax-free threshold for general land tax rates from $250,000 to $300,000 so tax will only have to be paid on land worth more than $300,000. There will be no change for land held on trust.

• Private gender-exclusive clubs will no longer be eligible for a land tax exemption.

• Victorians with taxable landholdings worth more than $1.8 million will see their land tax rate increase by 0.25%. For those with landholdings worth more than $3 million it will increase by 0.3%.

The Victorian Government has extended the Commercial Tenancy Relief Scheme (CTRS), providing rent relief and protections for commercial tenants and landlords experiencing hardship through the latest wave of the pandemic.

The CTRS was created in 2020 and reintroduced in July 2021 to support small to medium businesses. It will be extended to 15 March 2022 to provide further financial relief to commercial tenants.

The extended scheme is available to businesses with an annual turnover of $10 million or less and which have suffered a decline in turnover of at least 30 per cent due to COVID-19.

Wills and Probate

When a person dies leaving assets, usually the executor of a person's will or the closest next of kin (where there is no will) has to finalise the deceased's affairs.

There are two types of these grants:

Probate – where there is a will
Letters of administration – where there is no will

The Probate or Letters of administration once provided by the Court, empowers an Executor or Adminstrator to carry out the Will.

COVID-19 and the new Commercial Tenancy Relief Scheme:

The Commercial Tenancy Relief Scheme and accompanying legislation will be re-introduced in Victoria, set to apply retrospectively, effectively from 28 July 2021.

Highlights of the Relief Scheme

• rent relief for eligible tenants will be calculated by comparing their turnover for the final quarter of the 2020/21 financial year with turnover from the final quarter of 2018/19;
• tenants will be eligible for the scheme if the drop in turnover is greater than 30 per cent;
• the percentage drop will also determine the amount of initial rent relief available to the tenant;
• eligibility for the scheme will be a one-time test. Businesses which are eligible at the beginning of the scheme will remain eligible throughout, with the proportion of rent relief adjusted in line with their turnover;

Good news Homebuyers, the State Government is set to announce in their State Budget:

The Government will waive up to 50 per cent of stamp duty on newly built or off-the-plan homes valued at up to $1 million until June 30 2021.

Those buying existing homes will receive a 25 per cent discount on stamp duty, up to the same value.
