Victory at the Administrative Reviews Tribunal! 🥳🙌

Our client was refused a Australian Citizenship due to our client not being of ‘good character’ and that our client lied on her visa application about whether or not our client had any passed criminal history, convictions or pleaded guilty in or out of Australia.

We argued that the question was confusing and it is a difficult question for a person with competent English to comprehend and that our client never intended to mislead the department in relation to her previous criminal matter.

We further argued that our client was also of good character given the circumstances around the offending and what our client did to rehabilitate. I further argued that the offending in itself was out of character and should not be the sticking point of who our client actually is.

This was ultimately agreed by the decision maker.

A great ending for our client who had endured a tough life since migrating from Somalia and even whilst in Australia continues to endure a difficult life raising a child on their own.

Fair to say it was a very good way to start the weekend for our client. 👏🏽🥳

Farah Jama's life was turned upside down when in 2008 he was falsely accused and convicted of r**e and sentenced to six years in jail. Despite having no witnesses, and an alibi for being no where near the alleged crime, the prosecution relied on contaminated DNA evidence to secure a conviction. Jama, a young Somali-Australian, was left feeling hopeless and lost until his mother decided to search for a new lawyer who could help her son. That's when Kimani Boden, a African-Australian lawyer stepped in.

Boden from Starnet Legal took up the challenge to investigate Jama's case and, to everyone's surprise, found that neither Jama's previous lawyers nor the prosecutors had examined a crucial file on the initial complaint against Jama. Boden's investigation proved Jama's innocence, and after 16 months behind bars, he was finally exonerated. He went on to sue the state of Victoria for the wrongful conviction that had robbed him of his freedom.

Jama's story is a tragic example of the vulnerability of people from diverse cultural and linguistic backgrounds to miscarriages of justice, especially when financial resources are an issue. Prejudice and stereotyping can play a role, and there is no room for laziness in the criminal justice system when someone's future is at stake.

The Jama case has become a beacon of hope for those who have lost faith in the criminal justice system. It highlights the limitations and potential for human error in DNA evidence, which is often viewed as infallible. The case shows that new processes are needed in the way we handle scientific or medical evidence, and that the current trial by jury system is not capable of evaluating certain types of evidence.

Farah Jama's experience is a wake-up call for all of us to demand more transparency, fairness, and equality in the criminal justice system. His life was forever changed by a wrongful conviction, but thanks to the courage and dedication of his lawyer, Kimani Boden, he was able to regain his freedom and his life.
