Victory at the Administrative Reviews Tribunal! 🥳🙌
Our client was refused a Australian Citizenship due to our client not being of ‘good character’ and that our client lied on her visa application about whether or not our client had any passed criminal history, convictions or pleaded guilty in or out of Australia.
We argued that the question was confusing and it is a difficult question for a person with competent English to comprehend and that our client never intended to mislead the department in relation to her previous criminal matter.
We further argued that our client was also of good character given the circumstances around the offending and what our client did to rehabilitate. I further argued that the offending in itself was out of character and should not be the sticking point of who our client actually is.
This was ultimately agreed by the decision maker.
A great ending for our client who had endured a tough life since migrating from Somalia and even whilst in Australia continues to endure a difficult life raising a child on their own.
Fair to say it was a very good way to start the weekend for our client. 👏🏽🥳
