Children are the most sinned against members of society. Early exposure to violence impairs brain development, resulting in educational underachievement and emotional dysfunction.

In Australia, where the age of criminal responsibility remains just 10 years old, children at risk have learned from experience that adults are not to be trusted. Their respect for authority is shattered, having been victims of crimes far more serious than any offence they've committed.

🔍 Investing in Children, Not Prisons

Rather than wasting billions on incarcerating children, we should invest in battling child poverty by supporting families affected by violence and abuse, providing youth mentoring, refuges, and pediatric mental health facilities.

A substantial majority of imprisoned children reoffend within 12 months. Diversion programs are essential to prevent the stigmatising, soul-destroying effects of formal justice system involvement.

While the UN Convention on the Rights of the Child was unanimously adopted in 1989 and has been ratified by 196 countries as of February 2025, it's often used more for spin than substance. Few countries outside Scandinavia have implemented effective intervention programs that truly recognize the child's interests as paramount.

It's time to honor our obligations under the Convention with action, not just words.

🔍 Beyond Rehabilitation: The Reality for Children at Risk

Rehabilitation means to restore someone to health or normal life through training and therapy, but the baseline for children at risk is generally neither health nor normalcy. They cannot be restored to a condition they have never enjoyed.

As Dr. Martin Luther King Jr. recognized in 1967, "it is a cruel jest to say to a bootless man that he should pick himself up by his boot laces."

In 2021, UNICEF estimated that more than 261,200 children were in detention worldwide on any given day. North America has the highest regional rate at 137 per 100,000 children, while Latin America and the Caribbean has the greatest number of detained children.

As of June 2022, the average cost of imprisoning a child in Australia was almost $3000 a day. Most children in custody have undiagnosed disabilities and do not receive the help and support they need.

🔍 The Crisis of Indigenous Youth Incarceration

In Australia, Indigenous children are grossly overrepresented among children at risk. Indigenous young people aged 10-17 are 29 times more likely to be in detention than non-Indigenous youth.

Globally, the World Health Organization estimated that at the end of 2020, two billion children aged 2 to 17 had experienced physical, s*xual or emotional violence or neglect in the preceding year. Children are the most sinned against members of society.

Early exposure to violence can impair brain development, resulting in educational underachievement and emotional dysfunction. Children at risk have learned from experience that adults are not to be trusted.

Rather than continuing a system that fails our most vulnerable, we must address the root causes of this crisis.

🔍 Fighting for Children's Rights at Banksia Hill

Those children are current and former inmates of the juvenile detention center in West Australia. My firm, Levitt Robinson, has brought a class action against the West Australian government in the Federal Court of Australia.

The West Australian government was called out by Amnesty International in 2018 for its inhumane treatment of child detainees. Rather than make serious amends, the West Australian government has just doubled down.

Our class action looks back to 1997 with the closure of Rangeview and the establishment of Banksia Hill as the sole juvenile detention facility in WA. The testimonies allege physical abuse, restriction, restraint, breaches of the Disability Discrimination Act and inhumane treatment.

Populist political parties in Australia say they want to get tough on youth crime. Amnesty International has condemned Queensland's new "Adult Crime, Adult Time" approach—a cruel and dangerous policy that will disproportionately impact Indigenous youth.

When a child's basic needs aren't being met, that child is at risk, unlikely to make a successful transition to adulthood without society's help.

UNIT 18

Unit 18, which is located inside Casuarina maximum-security adult prison, was presented as a temporary solution to house Banksia Hill Detention Centre’s most ‘disruptive’ detainees when it opened in late July 2022. There are up to 20 juvenile detainees aged between 14 and 17 detained in Unit 18, most are indigenous, and many are disabled.

Shockingly, those detained at Unit 18 have been subject to even more punitive treatment than they were at Banksia Hill Detention Centre, as manifested in skyrocketing rates of self-harm and attempted su***de: between July 20 and August 8 2023, there were 13 incidents of self-harm and three attempted su***des, which coupled with the tragic death of 16-year-old indigenous detainee Cleveland Dodd, paints a grim picture of the systemic and individual failings of those tasked with the administration of Youth Justice Services in Western Australia.
And yet despite Premier Roger Cook’s recent admission that “Unit 18 does not meet our standards for care and safety” he justified its continued operation as a “necessary evil”.

PROSPECTIVE PHOSLOCK SHAREHOLDER CLASS ACTION

On 16 September 2020, PET announced it had discovered certain “irregularities” in its China operations. Later investigations revealed these consisted of widespread fraud, bribery and corruption, including bogus sales. PET’s 2019 financial statements, audited by KPMG, reported a $2.7 million profit; after investigating the fraud, this was restated as a $1.1 million loss.

The fraud in China meant that PET’s 2019 financial statements, and probably earlier financial statements and announcements, were incorrect and arguably misleading. They had the effect of artificially inflating the price of PET shares, well above their true value. Shareholders bought shares relying on these announcements and financial statements. They paid much more than the shares were actually worth.

Levitt Robinson is progressing a claim for shareholder losses by way of a class action against KPMG and/or PET’s former directors in relation to the misleading nature of the announcements and financial statements.

Aboriginal Community Police Officers are claiming damages for more than two decades of racial discrimination over pay and conditions, as well as compensation for pain and suffering, which they allege has been caused by systemic racism in the NT Police Force.

Landmark Class Action Against NT Government and Police Commissioner
Levitt Robinson Solicitors are representing Aboriginal Police Officers in a ground-breaking class action against the Northern Territory Government and the Police Commissioner. Officers allege decades of racial discrimination, including racial vilification, unequal pay and promotion, and a systemic lack of respect within the Northern Territory Police Service.

This is the first time serving Aboriginal Police Officers have taken collective action against their employer, highlighting the pervasive nature of systemic racism within the force. If conciliation fails, the case will proceed to the Federal Court, seeking substantial damages for racial discrimination and related harms.

Western Australia on Trial Over Death in Custody

Levitt Robinson Solicitors is currently running a class action in the Federal Court of Australia, claiming damages on behalf of First Nation’s people who were locked up under West Australia’s now defunct Fines Enforcement legislation.

First Nation’s men were 11 times over-represented, and First Nation’s women 18 times overrepresented, because of the government policy.

The class action is claiming damages for indirect racial discrimination under the Racial Discrimination Act 1975.

If you are an Aboriginal or Torres Strait Islander man or woman who went to jail for fine default between 1 January 2014 until 20 June 2020 register with us now.

The class action was filed in the name of the late Julieka Dhu, who was just 22 years old when she died in custody in police lock-up for unpaid fines, under the now defunct Fines Enforcement Legislation.
