Dear all our valued clients,

We hope you are all keeping safe within this tough and scary time. Please note, our office is still open at this time however, after careful consideration our office has implemented the following policies due to the current government recommendations related to the COVID-19:-

1. Until further notice we will NOT be taking appointments inside our office without a scheduled booking with one of our team. We ask that, unless absolutely necessary, appointments are not made. Any person attending upon our office without an appointment will be asked to leave;

2. Our firm remains fully operational. Staff will be working both in our office and remotely from home. Due to this we cannot guarantee that Staff will be immediately available should you call the office.
Our preference is that the first point of contact is by email to ensure prompt attention to your matter. We ask that, unless there is an emergency or tome sensitive matter associated with your file, all communication is by email.

We understand these measures may cause inconvenience, however we are taking these measures to ensure that not only our staff, but also our clients are best protected and any risk minimised.

We are also taking precautions within the office such as regular cleaning of chairs, door handles and desks with hand sanitiser readily available at the reception for anyone with an appointment.

What is the difference between a Will and an Enduring Power of Attorney?

A Will only comes into effect after death. This legal document sets out what you would like to happen with your money, belongings and other assets once you pass away. An executor is appointed whose job it will be to administer the estate and give to your beneficiaries named in the Will.

An Enduring Power of Attorney (EPOA) is a legal document that comes into effect whilst you are still alive (at a date you decide or once you lose capacity) and ceases once you die. It is a formal document which gives another person (or persons) the authority to make personal and/or financial decisions on your behalf.

When there is more than one purchaser it is very important to know the difference between the types of ownership agreement.
With joint tenancy comes the β€œright or survivorship”, meaning when one of the joint tenants die, their share of the ownership automatically passes on to the other joint owner and consequently does not form part of the estate of the deceased.

Alternatively, tenants in common does not come with a right of survivorship, they are simply just co-owners of the property. The shares do not have to be equal. If one of the tenants in common passes away, their interest in the property forms part of the estate and does not automatically pass onto the other co-owner of the property.
