πŸ“‹ Real talk: 30% of NSW estates are left without a valid Will.

If something happened to you tomorrow β€” who would raise your children?
Who would manage your assets?
Who would make the decisions?

"I'll get to it" isn't a plan. A Will is.

Here's why mums can't afford to wait any longer. πŸ‘‡

What is a Testamentary Discretionary Trust β€” and should you have one?

Let's break this down simply. πŸ™Œ

A Testamentary Discretionary Trust (TDT) is a trust that's set up inside your Will β€” it only comes into effect after you pass away.

The trustee (someone you appoint and trust) can then distribute your estate income and assets to your beneficiaries β€” children, grandchildren, other family members β€” in the way that makes the most sense for them at the time.

Why does that flexibility matter?

πŸ’› If one of your kids goes through a divorce, their inheritance is better protected from becoming part of the property split
πŸ’› If a beneficiary is going through financial hardship, the trust can shield those assets from creditors
πŸ’› It allows for income distribution that can be tax-effective for your family

In short β€” it's estate planning that keeps working for your family long after you're gone.

Short answer: yes. And here's why. πŸ‘‡

One of the most common things we hear is "I don't have enough to bother with a Will." But estate planning isn't just about money.

A Will lets you decide:
β†’ Who looks after your children if something happens to both parents
β†’ Who manages your digital accounts, your home, your belongings
β†’ How your super is directed (hint: it doesn't automatically go to your estate)
β†’ That your wishes are followed β€” not left to a court to decide

Even a modest estate can become a complicated, expensive mess without a valid Will in place.

Don't leave the people you love guessing. A Will is clarity. It's a gift. πŸ’›

You work hard, love your family fiercely, and somehow still manage to hold it all together. ✨

But here's a question worth sitting with: if something happened to you tomorrow, would your family know exactly what to do?

Estate planning isn't just for the wealthy or the elderly. It's for every parent, every partner, every person who has people they love and assets they've built.

The good news? It's simpler than you think β€” and it's one of the most loving things you can do for your family.

Big news from the 2026 Federal Budget β€” and it directly affects anyone with (or considering) a Testamentary Discretionary Trust in their Will. πŸ“‹

Here's what you need to know, without the jargon:

βœ… The government proposed a 30% minimum tax on discretionary trust income from 1 July 2028.
βœ… New TDTs established under Wills will be subject to the new 30% minimum tax rules from 1 July 2028.

Does this mean TDTs are no longer worth having? Not at all.

The asset protection benefits β€” shielding your kids' inheritance from relationship breakdowns, financial hardship, and unforeseen claims β€” remain completely intact.

But it does mean the timing of your Will matters more than ever. And if you've experienced any nig life events, this is your reminder to give us a call.

We're here to help you make sense of it. Book a chat at copelandlegal.com.au πŸ‘†

What happens when you die without a will?

When you pass away without a will (known as dying intestate), your State or Territory's intestacy laws determine how to distribute your assets.

In NSW, your estate may be distributed between your spouse or de facto and your children, or even your parents or siblings.

Dying without a will means your wishes may not be respected and the people you care for may not be looked after.

Assets may be frozen, disputes may arise and clarity for loved ones could be jeopardised whilst the government decides how to distribute your assets for you.

Creating a will and keeping it up to date is essential to ensure wishes are honoured and the ones you love the most are protected and provided for.

πŸ‘‰Any changes in your family including any births, deaths, adoptions or new grandchildren.

πŸ‘‰Acquiring or disposing of significant assets or major changes in your financial circumstances.

We are here to guide you through the process and ensure your wishes are properly documented, legally valid and that they include as many safety nets as possible for life's uncertainties.
