โš–๏ธ What Happens After Court? Hereโ€™s What You Need to Know

Whether you're acquitted or convicted, your legal journey may not be over when the verdict is read. Hereโ€™s what you should expect:

โœ… If Youโ€™re Found Not Guilty
The matter is generally over.
โ€ข In the Magistrates Court, you might be able to recover some legal costs from the Australian Federal Police.
โ€ข In Supreme Court matters, however, thereโ€™s no cost recovery process in place.

โŒ If Youโ€™re Found Guilty
The process moves to sentencingโ€”this may happen immediately or at a later date, depending on the case.

At sentencing, the court will take into account:

๐Ÿ”น The seriousness of the offence and its effect on others
๐Ÿ”น Your personal background, including previous history and character
๐Ÿ”น Any existing criminal record

๐Ÿ“ข Considering an Appeal?
A guilty verdict doesnโ€™t have to be the end.
If there's been an error in the legal processโ€”or if the sentence feels excessiveโ€”you may have grounds to appeal either the conviction, the sentence, or both.

But act quickly! โณ Appeals generally must be lodged within 28 days. Missed the deadline? You may still appealโ€”but you'll need permission from the court.

If you're suddenly facing a summons or have been arrested in the ACT, it's essential to understand what comes nextโ€”and how to protect your rights.

The police will inform you if they intend to lay charges.
โœ” If you're granted police bail, you'll receive a date to attend court.
