Before you panic: if you are already enrolled and studying, your course does not end. You can finish.

What ends on 5 October 2026 is new commencements.

And please do not rush to start a course just to protect your visa. In packaged courses especially, that can create a Genuine Student problem later.

The Government's own documents reveal how serious the partner visa backlog really is.

131,000+ partner visa applications are currently waiting.
Only 40,500 places are allocated per year.

That's years of waiting for most couples.

The good news: Ministerial Direction 117 (effective July 2026) now gives onshore applicants higher priority than those offshore. If you're already in Australia, you move up the queue.

But priority processing isn't automatic — you need to show BOTH compassionate AND compelling grounds.

✅ What CAN qualify for priority:
→ Long-term relationship (3+ yrs, or 2+ with children) at lodgement
→ Sponsor's serious or terminal illness / disability
→ LGBTQI+ couple in a country not recognising same-sex relationships
→ Family violence claims
→ Pregnancy complications threatening health of mother or baby
→ Medical examinations about to expire
→ Safety at risk due to conflict or natural disaster
→ Country subject to international emergency or evacuation
→ Dependent child approaching the 23-year age cut-off
→ Processing beyond the 90th percentile globally

❌ What does NOT qualify on its own:
→ Financial hardship
→ Pain and suffering of separation
→ Pregnancy (without medical complications)
→ Intending to start a family
→ Employment or travel reasons
→ Pre-arranged wedding plans or passport expiry

🚨 NT SKILLED NOMINATIONS NOW OPEN – 2026-27

Big news: the Northern Territory has secured 1,850 nominations for 2026-27 — the HIGHEST Subclass 491 allocation of any Australian jurisdiction.

Nominations are open now (from 8:00am today, 21 August 2026):
✅ 1,000 × Subclass 491 — Skilled Work Regional (Provisional)
✅ 850 × Subclass 190 — Skilled Nominated (Permanent)

That's 200 more than last year (up from 1,650). Allocations close when full — so if NT nomination is part of your pathway, act now.

The NT Government advises applicants to "seek professional advice from a Registered Migration Agent" — that's exactly what we do.

⚠️ FAMILY VISA QUEUE RESHUFFLED — 25 JULY 2026

Ministerial Direction 117 is now in effect, replacing Direction 102. Whether you have a family visa application already waiting or are about to lodge one — the processing order has changed.

🔑 The biggest shift: Being IN Australia when you apply now puts you in the HIGHER priority group, ahead of equivalent offshore applicants.

📋 The full processing order (within each group):
1️⃣ Ministerial Intervention cases
2️⃣ Partner & Child visas
3️⃣ Orphan Relative visas
4️⃣ Contributory Parent visas (SC 143, 173, 864, 884)
5️⃣ Carer visas
6️⃣ Parent & Other Family visas (SC 103, 804)

This applies to:
✅ New applications lodged from 25 July 2026
✅ Existing undecided applications already in the queue

If the Department asks for more information about your partner visa, that request is now your only opportunity to respond.

No reminder. No second letter. If the deadline passes, your application can be decided on whatever is already sitting in your file.

Partner visas are the one category where the evidence has to keep being true. The question is not whether your relationship was genuine when you applied — it is whether it is genuine and ongoing today.

Four things worth checking this week:

✓ Any request for extra time must be made WITHIN the original timeframe, with reasons
✓ Refresh your relationship evidence every 6-12 months while you wait — financial, household and social
✓ At the two-year mark the permanent stage does NOT start automatically. Someone has to commence it in ImmiAccount
✓ Check your ImmiAccount contact details are current, and check the account regularly

Most of the trouble we see is not caused by weak relationships. It is a letter nobody opened, evidence that stopped at lodgement, or a form nobody commenced.

2026–27 MIGRATION PROGRAM: SAME TOTAL, VERY DIFFERENT DOORS 🇦🇺

Almost every write-up has led with the same number — regional places cut 57%. It's accurate. On its own, it's misleading.

Here's the figure nobody is quoting 👇

The total Skilled Migration Program went from 132,200 places to 132,240.

Forty extra places. Nationally.

This was not a cut. It was a reallocation of roughly 19,000 places:

✅ Employer Sponsored — 44,000 → 58,040 (+32%)
✅ Skilled Independent 189 — 16,900 → 21,090 (+25%)
✅ State/Territory 190 — 33,000 → 35,500 (+8%)
🔻 Regional 491 — 33,000 → 14,110 (−57%)

Same pie. Very different slices.

📌 And the clearest signal in the whole document, which most coverage skipped: of the 185,000 total places, 129,590 are for migrants already living in Australia. Only 55,110 for offshore applicants.

Roughly 7 in 10 permanent places this year are reserved for people already here.

⚠️ One technical point that's frequently reported wrong: in the planning levels, "Regional" means subclass 491 ONLY. The 494 is a regional visa but sits under Employer Sponsored, because it's employer sponsored. Mixing these up makes the cut look bigger or smaller than it is.

⚠️ And a caution — planning levels are ceilings, not guarantees. More places in a category means more capacity, not an easier application. They say nothing about whether your occupation is listed, whether your points are competitive, or whether a state will nominate you.

TASMANIA 2026–27: 2,050 NOMINATION PLACES CONFIRMED

Migration Tasmania has released its allocation for the new program year:

✅ Subclass 190 (Skilled Nominated) — 1,250 places
✅ Subclass 491 (Skilled Work Regional) — 800 places
✅ Reopening to new Registrations of Interest in the coming weeks

Here's why the 491 number matters more than it looks 👇

Nationally, subclass 491 places were cut from 33,000 to just 14,110 for 2026–27 — a 57% reduction. Tasmania is holding 800 of those 14,110. That's around 5.7% of every 491 place in Australia, in a state with barely 2% of the population.

If your realistic path to PR runs through the 491, Tasmania deserves a serious look this year.

⚠️ But read this carefully before you act:

Tasmania does NOT nominate on points alone. Its pathways (TSE, TSG, TER, TBO) are built around a genuine connection to the state — employment, study, residence or business. High points with no Tasmanian connection will not get you there.

⚠️ And if you already have a 491 nomination application lodged but undecided, Migration Tasmania has confirmed it will NOT be considered for 190 nomination. Switching means withdrawing what you already hold, with no guarantee of an invitation in return. Get advice before you withdraw anything.

✅ Still available: partner visas (820/801), skilled visas (190/491/494), protection visas, bridging visas, and medical treatment visas (602)

❌ Blocked onshore: work visas (482/186), student, visitor, and graduate visas
Don't lodge another application without getting advice first. One wrong application can make things worse.

Student visa refused? New rules change how the ART reviews your case — effective 1 June 2026.

Most refusal reviews will now be decided on the papers (written submissions only — no hearing). The ART will invite you to submit evidence on your enrolment before deciding.

Two key deadlines apply:
📌 28 days to respond to an s367F invitation — missing this means your review is dismissed.
📌 14 days for s367G — late replies are still considered if no decision has been made yet.

Does not apply if the refusal involved character, fraud, health, debt or Special Return Criteria.

Deadlines are strict. Get advice before you respond to any ART invitation.
