I'M SEPARATING, DO I NEED TO GO TO COURT? - No, not necessarily. Majority of matters resolve without the need for initiating Court proceedings.

In matters that do need Court intervention, they often resolve along the Court pathway, and don't require a Judge to make a decision at a Final Hearing.

BUILDING INSPECTION REPORTS - The Victorian Government has suggested a change to the legislation to require a vendor to provide a Building Inspection Report, rather than the purchaser paying for their own.

If re-elected, it is suggested that this legislation amendment (if passed) will come in to effect from 2027. However, without safeguards in place regulating such reports, then the independence and reliability of such reports is questionable.

MEET ELIZA - Eliza has been with the firm since its inception in 2003. Eliza has practised exclusively in family law, so has an enhanced understanding of family law matters and is attuned to the needs of her clients. In 2015, Eliza attained Accreditation from the Law Institute of Victoria as a Family Law Specialist. Through her experience at JH Legal, she has acquired a broad knowledge of complex financial matters (between both married and de-facto couples) often involving company and trust structures, children's issues, child support disputes, conveyancing and property transactions, relocation cases and divorce applications.

Eliza has a comprehensive understanding of the commercial realities involved in negotiating a family law settlement and attempting to reach a resolution as expeditiously and as cost-effectively as possible for her clients. PROPERTY OWNERSHIP - If you own your property as joint proprietors, then the surviving proprietor automatically receive the ownership of the property and this property is excluded from your estate to be divided between your surviving beneficiaries.

To have this ownership reflected on Title, you must lodge an Application by Surviving Proprietor with Secure Electronic Registries Victoria (formerly Land Use Victoria).

The registration of your interest on Title is especially important in the context of estate planning.

KIDS' CHARTER - The Federal Circuit and Family Court of Australia has recently announced a "Kids' Charter", which is a document that has been published for children who may have parents involved in Court proceedings.

The charter is designed to let children know that:

• They are the Courts top priority
• The Court cares what children think
• The Court wants children to understand what is happening
• The Court wants it to feel safe for children
