Rights and obligations of same-s*x couples.

As all of us know, from March 2009, same-s*x couples have to follow the same legal principles as parties to a marriage and have the same rights.

This means that, financial settlements and superannuation can be split between same-s*x couples following their relationship breakdown, and spousal maintenance can also be ordered.

The definition of ‘family violence’ is broad. You may be unaware that some behaviours, while not condoned by you, are acts of family violence.

A parenting plan is a private agreement entered into by parents. Unlike a court order, a parenting plan is not enforceable by the court - however it may be produced to the court as evidence of the parent’s intention and in support of an application for a parenting order.

A parenting order will be based on the child’s best interests. The Family Law Act sets out the issues to be taken into consideration by the court when determining the order that will be in the children’s best interests.

A final property settlement may be agreed on upon the breakdown of a marriage or de facto relationship. A final property settlement provides certainty as to the division of the assets, liabilities and superannuation of the relationship.

We recommend that when finalising your property settlement, you also review your Will and binding nominations with respect to your superannuation and insurance policies.
