Machinery plays an important role across many Australian workplaces, but when safety procedures are skipped, equipment is poorly maintained or hazards become normalised, the consequences can be serious.

Machinery-related injuries are not always caused by reckless behaviour. They can happen when:

• Safety guards are removed or bypassed
• Machinery is not properly isolated before maintenance
• Training or supervision is inadequate
• Workers are placed under pressure to move quickly
• Fatigue, noise or poor visibility affect safety
• Known hazards or near misses are not addressed

According to the latest Safe Work Australia data, machinery operators and drivers recorded 18,300 serious workers’ compensation claims in 2023–24, with a median of 9.4 working weeks lost per claim.

Behind every statistic is a worker, family and workplace affected by an injury that can have consequences well beyond the initial incident.

Workplace safety should never be treated as optional. Reporting hazards, following isolation procedures and speaking up when something feels unsafe can make a meaningful difference.

A Total and Permanent Disability (TPD) claim is assessed against the specific terms of the relevant insurance policy.

Before beginning the process, it can be helpful to check what cover you hold, understand the policy definition and gather clear medical and employment records. You may also have insurance through more than one current or previous superannuation account.

Every policy and personal situation is different, so the outcome will depend on the applicable terms and supporting information. TPD insurance commonly provides a lump-sum benefit where the insured person meets the policy’s definition of total and permanent disability.

Every legal matter starts with a conversation, and every conversation starts with listening.

Taking the time to understand someone's circumstances, answer questions and explain the process clearly lays the foundation for informed decisions. It's an approach we believe makes all the difference.

Because before the paperwork, before the process and before the next steps, there's a person with a story to tell.

The waiting can often be one of the most challenging parts of any legal process.

Not every stage is visible, and there may be times when progress happens behind the scenes through reviewing information, preparing documents or corresponding with others involved.

Clear communication can make all the difference. Understanding what is happening and why helps people feel more informed throughout the process.

Episode 3: The Early CTP Forms

Welcome back to our Road Accident Claims Process Series, where we explain the key stages of a typical claim and answer some of the questions people commonly have along the way.

After the initial conversation, there may be several early forms and documents to complete.

Depending on the circumstances, this can include:

• Reporting the accident
• Obtaining a medical certificate
• Completing the relevant CTP claim form
• Providing details about the accident and injuries

Knowing which forms are required, what information to include and when they need to be completed can help make the process feel more manageable.

Stay tuned for Episode 4, where we explain how Vilic Law can help with preparing and lodging these documents.

A visit to the shops should feel routine, not stressful.

When someone is injured in a shopping centre, the effects can extend well beyond the incident itself, affecting health, confidence, routine and day-to-day life. In Queensland, shopping centre incidents may fall within the broader area of public liability law, which looks at whether reasonable steps were taken to keep an area safe.

Common areas such as walkways, entrances, food courts and car parks all need to be managed with visitor safety in mind. Situations involving wet floors, uneven surfaces, faulty escalators or lifts, falling objects, poorly maintained car parks, or inadequate lighting can all raise safety concerns depending on the circumstances.

Early information can be helpful after any incident. Keeping records, noting what happened and understanding the process can make it easier to work out next steps.
