FAQ: What is a TDT Will?

Answer: TDT stands for Testamentary Discretionary Trust.

"Testamentary" because the trust is established inside a Will.

"Discretionary" because the trustee has discretion to allocate income and capital among certain beneficiaries.

"Trust" because the inheritance is held on trust for the beneficiaries (and sometimes the Willmaker's descendents).

TDT Wills are commonly used to protect beneficiaries who:
• are in occupations which expose them to personal liability;
• may be at risk of a relationship breakdown;
• have special needs or vulnerabilities; or
• have a history of poor financial management.

A TDT Will allows assets to be managed by a trustee, who can make appropriate decisions about how funds are applied for the benefit of the beneficiaries.

This structure can help support the financial security and educational needs of your children and grandchildren well beyond your lifetime.

FAQ: We don’t have Wills yet, but we need to provide for our children if we both pass away. What’s the best way to get started?

Answer:
As a parent, it is your responsibility to decide who will take on the roles of Executor and Guardian in your Will.

These roles help ensure your children are cared for and that their financial and personal affairs are properly managed if you pass away before they reach 18 years.

Getting started usually involves:
- appointing guardians for your children;
- appointing Executors you trust;
- considering how and when your children should receive their inheritance; and
- putting safeguards in place to manage funds until your children are old enough.

An estate planning lawyer can help you work through these decisions and prepare documents that reflect your family’s circumstances.
