Date: 14 August 2025
Result: $100 fine and minimum 1 month mandatory disqualification of licence.
The unfortunate thing about any drink or drug driving charge is the court is obliged to disqualify you for a minimum legislative mandated period. The goal is to achieve the minimum, or apply for a work licence if possible, to allow you to get back on the road as soon as possible.

As of May 5, 2016, it is an offence in Queensland to choke, strangle or suffocate a person in a domestic setting.

There are defences available to the defendant for the offence. They include self-defence, duress and intoxication. However, provocation is not a defence due to the nature of the offence and what may constitute ‘provocation’ in a domestic relationship. If you believe that you have a defence against the offence, the prosecution will have the onus to prove that you were not acting in self-defence or under duress.
