🐣 Happy Easter from Saines Legal! 🌼

Yesterday we had the joy of delivering Easter hampers to some of our amazing clients & colleagues – a little token of appreciation for the continued trust and relationships we value so much. A nice photo of Elita and Reece from Hornick Constructions.

A huge thank you to

Wishing you all a safe and happy Easter break from the team at Saines Legal 💛

We have put together a brief outline on our experience and recommendations with resignation as an employee below.

Resignation is when an employee decides to leave their employment and tells their employer. An employee may need to give notice when they resign.

An award, enterprise agreement or employment contract may set out how much notice an employee needs to give an employer.

The notice period:
- starts the day after the employee gives notice that they want to end their employment; and
- ends on the last day of employment.

An employee who isn’t covered by an award or agreement doesn’t have to give notice to an employer before resigning. However, an employment contract may require that employee to give notice. An employment contract can't provide less than the legal minimum set out in awards and agreements.

The Queensland Government introduced new requirements for stronger regulation of s*xual harassment and s*x or gender-based harassment at work in March 2025.

These regulations make it clear that workplaces need to be proactive about preventing s*xual harassment and s*x or gender-based harassment.

Employers can manage these risks by identifying risks, implementing control measures in accordance with the hierarchy of controls, reviewing control measures and implementing a prevention plan.

How your business responds to reports of harassment can impact and define the experience of the person reporting harassment.

If you have not yet implemented a Sexual Harassment prevention plan and policy for reporting, please contact Saines Legal today for a consultation.

Rosalind and Paul attended the Y.E.R.N.S networking event last night (Young Employment Relations Networking Society) hosted by Industrial Relations Society Of Queensland.

The feedback was a wonderfully engaging and insightful event which was made enjoyable by the relaxed and approached environment Commissioner Pigeon of the QIRC (guest speaker) made the guest feel. It was an opportunity to meet other young lawyer in the industrial relations/employment law space.

Abandonment of employment is generally when an employee doesn’t:
- come to work for an unreasonable length of time; or
- have a reasonable excuse; or
- speak to their employer about being away.

Modern awards don’t contain abandonment of employment clauses. A small number of modern awards did contain these clauses but the provisions stopped applying from the first full pay period on or after 20 December 2018.

An employer should make all reasonable attempts to contact an employee who they think may have abandoned their employment. This is because sometimes things go wrong and an employee genuinely can't contact their employer.

Copy link below and you can read an article on our website about this:
https://saineslegal.com.au/2021/03/termination-or-resignation-jurisdictional-woes-for-employers/

Employers who are concerned that an employee has abandoned their employment should seek independent legal advice.
