It comes down to a question of control. If a trust is controlled by a spouse to the extent that it would put the assets of the trust in the same position as if the spouse were the owner of the assets, they will be included in the assets to be divided. Your Application for Divorce must include:
Two affidavits – written statements explaining the nature of your relationship before and after separation, your current living situation and plans for the future.
