Major Changes to Australia’s Subclass 186 (ENS) – Work Experience Rules

Effective 29 November 2025, significant updates will apply to the Subclass 186 Temporary Residence Transition (TRT) pathway.

🔹 Only work performed under an Approved Work Sponsor will count towards the required 2 years of experience for Subclass 186 TRT.
🔹 If the employer’s Sponsorship or Labour Agreement expires, the work done during that period will NOT be recognised.
🔹 TRT applicants must now complete the full 2 years only under an Approved Sponsor.
🔹 If a Sponsor fails to meet their obligations, the worker’s 482 visa can be cancelled.
🔹 Applicants applying for a 482 visa from outside Australia now have the right to appeal refusals at the Administrative Review Tribunal (ART).
🔹 Up to 180 days of non-sponsored employment may be counted, provided the worker is later properly nominated by the employer.

📌 What this means for visa holders & employers:
– Employers must ensure their sponsorship remains valid throughout the worker’s employment.
– Visa holders need to be aware that only approved-sponsor employment will count towards PR.
