Trusts have been making headlines lately following the 2026 Federal Budget proposals. Coincidentally, a recent Family Law appeal decision involving a family trust has added another layer to an already complex question: Are trusts still effective structures for asset ownership and protection?

The latest decision involved a family business and whether trusts used for intergenerational wealth can be considered assets as part of a property settlement. Involving a wife, a trust, and her late husband's children, it is a reminder that the way a trust is structured, managed and used can have significant implications in family law matters.
