Visa Changes for Graduates

The Temporary Graduate Visa (Subclass 485) will see the “Graduate Work” stream renamed “Post-Vocational Education Work” and the “Post-Study Work” stream renamed “Post-Higher Education Work”.

The “Second Post-Study Work” stream will have a similar renaming, and the “Replacement” stream will be discontinued.

Eligibility will now be based only on the qualification used to meet the Australian study requirement. The maximum age limit will be reduced to 35 years, except for Hong Kong and British National Overseas (BNO) passport holders (under 50 years) and those who are using a Masters (research) or Doctoral Degree to meet the Australian study requirement (under 50 years).

Stay periods will change to up to 18 months for the Post-Vocational Education Work stream, and 2-5 years for the Post-Higher Education Work stream, depending on the degree level and nationality.

A New “National Innovation Visa”

The Australian Government plans to introduce a new National Innovation Visa at the end of 2024 to attract exceptionally talented migrants to boost economic results for Australia.

“Visas for people with in-demand skills will also come with a clear path to permanent residency, in a bid to attract overseas talent Australian industries most need,” (Reported by SBSNews.com)

The intention is for this to replace the Global Talent Visa and BIIP.

A series of reforms were introduced to support the integrity of the international education system and genuine international students, including the Genuine Student Requirement, English language requirements, and financial capacity requirements.

The latest Provider Update in July 2024 covers significant developments and statistics related to Student and Temporary Graduate visas.

Key points include:

Student and Temporary Graduate Visa Data:
• There were 580,193 student visa applications lodged globally in the 2023-24 program year, a 1.75% decrease compared to the previous year.
• The grant rate for applications lodged in Australia was 83.7%, while it was 78.3% for those lodged outside Australia.
• Data from the Department of Home Affairs shows that 441,613 student visas were lodged from July 2023 to May 2024, with 289,509 granted.

It is worth noting, reporting on Australian student visas approval rates have dropped significantly to be the lowest level in nearly two decades. The focus on students comes after an announcement from government in December 2023 to decrease immigration to pre-pandemic levels. Students are one of the largest proportions contributing to net migration.

Victoria’s 2024-25 skilled visa nomination program is now open to new Registrations of Interest.

To be considered for selection for Victorian skilled visa nomination, you must first submit a Registration of Interest (ROI).

To register your interest for Victorian nomination, you must:
1. Meet the current eligibility requirements,
2. Have an up to date and accurate SkillSelect Expression of Interest (EOI), and
3. Submit a new Registration of Interest

To start your 2024-25 Registration of Interest, log in to the Live in Melbourne portal.

All Registrations of Interest submitted in previous years have expired.

There is no cost for submitting a Registration of Interest or a nomination application.

Registration of Interest does not guarantee nomination. The program is competitive and there is no set timeframe for when you may be invited.

Once submitted, your Registration of Interest will remain in the system until withdrawn or invited.

The Migration Amendment (Strengthening Reporting Protections) Regulations 2024 aims to enhance protections for temporary migrant workers by preventing visa cancellations related to workplace exploitation matters.

Effective from 1 July 2024, these amendments prescribe circumstances in which the visa of an affected temporary migrant worker must not be cancelled and outline matters the Minister must consider before deciding on visa cancellations.

The regulations seek to provide greater clarity and confidence to temporary migrants, encouraging them to report exploitation without fear of losing their visa status.

The Australian Government has allocated 1,800 nomination places to the Australian Capital Territory (ACT) for the 2024-25 program year.

The ACT's allocation consists of:
Skilled Nominated visa (Sc 190) - 1000 places
Skilled Work Regional (Provisional) visa (Sc 491) - 800 places

The ACT Government have advised that the date of their next invitation round will be held before 31 August 2024.
