Australia’s national security laws are changing, and not in a small way.

The ASIO Amendment Bills 2025 propose making compulsory questioning powers permanent. What was supposed to expire in 2005 due to the severity of its civil rights infringments has been renewed and extended by successive Labor and Liberal governments since. It is now being pushed to stay forever, with an expanded scope that includes sabotage and promoting communal violence.

Compulsory questioning means ASIO can legally require individuals to answer questions, produce documents, and appear before an officer, without charge, without conviction, and with no right to silence.

The civil liberties concern here is real. Permanent powers with an expanded scope and no sunset clause means less parliamentary oversight, less accountability, and more room for these powers to be used more broadly over time.
