Many people still think that Partner Visa applications are currently assessed the same way as 2 years ago, while after many years of working and handling Partner Visa applications, JL realizes that there are many applications that are not weak at all, even the relationship is completely genuine, but are still underestimated just because the presentation of the application still carries an old mindset.

The current reality is that the Department of Home Affairs does not only look at whether the Couple truly loves each other or not, but also assesses how the relationship is Submitted and shown throughout time through the entire application.

Below are the most common misunderstandings:

Reality:

The Department of Home Affairs does not only see “genuine or not” but assesses how you prove that. If:
- Unclear timeline → suspected
- Lack of Submission → not understanding how the relationship developed
- Fragmented evidence → failing to create an overall picture

A genuine relationship but poorly presented can still be refused.

- If only lodging once then “leaving it there” → the application lacks continuity

Many people believe that when a Visa application is Refused, they only need to lodge an application to the ART to "appeal" and wait for results.

In reality, it is not that simple.

The ART does not only review the decision of the Department of Home Affairs. This is a stage where the application can be re-evaluated based on the entirety of the evidence, testimonies, Submission and supplementary documents that the Client provides.

That also means, if the initial application still had points that were not convincing enough, not clearly presented or did not fully reflect the actual circumstances, then the ART is precisely the opportunity to clarify those issues.

This is also the reason why JL Migration & Education always views the ART as a stage needing thorough investment, rather than merely the next step after an application is Refused.

For each ART application, the Team will review the entire decision of the Department of Home Affairs to determine:
- Why was the application Refused?
- Which arguments were not convincing enough?
- What evidence needs to be supplemented?
- How should the Submission be written to focus correctly on the issues that the Tribunal will consider?

An effective ART application is not an application supplementing many documents. More importantly, every piece of evidence and Submission content must have a purpose, have connectivity and directly handle the reasons that led to the Refusal decision.

A noteworthy point is that if the opportunity at the ART continues to be missed, bringing the case to higher Court levels will usually be much more difficult. These Court levels mainly review whether or not the ART made an error of Law during the trial process, rather than re-evaluating the entire application to decide on a Visa Grant.

Therefore, for many cases, the ART is not just a step in the review process. This can be the most important opportunity for the Visa application to be reviewed in a fuller and more comprehensive way.

In the context of Australian Migration tightening its assessment and undergoing comprehensive reform, handling an application the old way is sometimes like… walking with an outdated map.

→ but not clarifying the timeline, development, and continuity
- Only responding when the Department of Home Affairs requests
→ at that time the application is already in a passive position

The current way must be different:
- Identify the right direction from the start (choosing Visa type, choosing lodgement time)
- Foresee risks and handle them right in the initial application
- Clear Submission: why you are coming to Australia, why it is a compelling reason, why you will comply with the Visa
- Prepare the application like a “complete story”, not a collection of papers

It is not that the Law is harder. But the Department of Home Affairs is 𝗮𝘀𝘀𝗲𝘀𝘀𝗶𝗻𝗴 𝗶𝘁 𝗺𝗼𝗿𝗲 𝗱𝗲𝗲𝗽𝗹𝘆.

From 05/07/2026, Transport for NSW will put into operation many new bus routes using electric buses, connecting Mount Druitt, Penrith, Liverpool, Campbelltown and Leppington with Western Sydney International Airport.

All new routes such as 772, 790, 825, 845 and 860,... will operate 7 days/week, from 5 AM to 10 PM, with a frequency of approximately 30 minutes/trip.

Although Western Sydney International Airport is expected to welcome Passengers from 10/2026, the new bus routes will begin serving from July, creating favorable conditions for Workers and Residents in the area.

Western Sydney is continuing to develop strongly and the public transport system is also being expanded to meet the increasing travel needs of the Community.
