Many business owners hesitate to pursue an unpaid debt because there was no formal written contract.
💡But the absence of a written contract does not always mean that the debt cannot be pursued.
🔎In many debt recovery matters, the question is whether there is enough evidence to show what was agreed, what goods or services were provided, when payment was due, and what amount remains unpaid.
🔑That evidence may include invoices, purchase orders, emails, text messages, delivery records, payment reminders, payment history, or other documents showing how the parties dealt with each other.
For a creditor, this can be an important point to understand. The issue is not only whether a formal contract exists. The issue is whether the available documents and communications are sufficient to support the claim and whether further recovery steps may be appropriate.
At Grope Hamilton Lawyers, we assist clients with debt recovery matters by reviewing the available documents, identifying the legal issues that may affect the position, and advising on the next appropriate step.
Unsure whether the available evidence is enough to support an unpaid debt? Speak with our debt recovery lawyers on (08) 8231 0088 to understand what options may be available!

💡Workplace psychological injury matters are not always linked to one sudden incident.
In some cases, the concern may arise from the way work is organised or managed over time. This may include excessive workload, understaffing, constant pressure, unclear roles, limited support, or difficult workplace interactions.
🔎However, workplace stress does not automatically mean that a person is entitled to compensation. In South Australia, whether a workplace psychological injury is compensable will depend on the circumstances of the matter, the medical and factual evidence, the connection between the injury and employment, and the requirements under the applicable workers compensation framework.
🔑This is why these matters should be considered carefully. The issue is not simply whether the workplace was stressful, but whether the circumstances support an entitlement to compensation under the relevant legal framework.
Contact Grope Hamilton Lawyers on (08) 8231 0088 if you have suffered psychological injury in connection with your employment. We can assist you in understanding your legal rights, assessing your entitlement to compensation, and protecting your position throughout the process.

Are you considering incorporating a company for a new business, commercial transaction or related trust structure?
💡Company incorporation is often seen as a registration process, but the details behind the registration can have important legal and practical consequences.
Before a company is incorporated, it may be necessary to consider who will act as director, who will hold shares, how the share structure will be arranged, whether a constitution is required, and whether the company will be connected to a trust, business purchase, lease or other commercial arrangement.
🔎These matters can affect how the company is owned, managed and documented from the beginning. They may also become important later if the company enters into contracts, takes on obligations, brings in another shareholder, changes its structure, or becomes involved in a dispute.
🔑At Grope Hamilton Lawyers, we assist clients with company incorporations, off the shelf companies, fast turnaround company registrations and related trust formations.
If you are considering incorporating a company and are unsure what structure or documents may be required, contact Grope Hamilton Lawyers on (08) 8231 0088 for advice based on your circumstances.

💡An e-scooter injury may involve different legal considerations depending on the circumstances.
🔎If a rider is hit by a motor vehicle, the issue may involve the conduct of the driver and whether a CTP claim can be made against the at-fault vehicle’s insurer.
🔎If the accident involves another e-scooter, e-bike or bicycle, the question may be whether that person failed to take reasonable care. The CTP Insurance Regulator states that accidents caused by bicycles or personal mobility devices, including e-scooters and e-bikes, are not covered by CTP insurance because they are not considered motor vehicles. However, a claim may still be considered against the rider, their insurer, or, in some circumstances, a commercial hire operator’s public liability insurer.
🔎If the rider falls because of a dangerous surface, obstruction, poor maintenance, or an unsafe public or private area, the issue may involve public liability. In that situation, the legal question may include whether someone owed a duty of care, whether that duty was breached, and whether the breach caused the injury.
🔑If you have been injured in an e-scooter, e-bike, bicycle or road-related accident and are unsure whether you may be able to claim, contact Grope Hamilton Lawyers on (08) 8231 0088 for advice.

Many business owners looking at commercial premises focus first on location, visibility and how the business will present to customers once trading begins.
💡But the signage position is not always settled simply because the premises have been secured. Depending on the lease and the proposed signage, questions may arise as to whether signage is permitted, whether the landlord’s consent is required, and whether the business can proceed in the way first intended.
🔎What may initially seem like a branding or fit-out issue can, in practice, affect how the premises are presented to the public, when the business is ready to open, and whether additional cost, delay or further approvals need to be addressed before signage can be installed.
🔑If those matters are not clarified early, a business may later find that the intended signage cannot proceed in the form first proposed, or cannot be implemented without further steps being taken. If you are negotiating a lease, reviewing business premises documents, or preparing to move into commercial premises, raise the question before you proceed. Contact Grope Hamilton Lawyers on (08) 8231 0088 today.

💡Blended family arrangements can make estate planning more complex, particularly where a person wishes to provide for children, stepchildren, a spouse, a former partner, or other family members.
🔑In South Australia, if a person dies without a valid will, their estate is distributed according to the laws of intestacy. A stepchild who has not been formally adopted is not automatically treated as a child of the deceased for this purpose.
This means a stepchild may not inherit under the intestacy rules unless they have been clearly provided for in a valid will.
🔎A stepchild may be able to make a family provision claim in some circumstances, but that is different from being clearly named and provided for in an estate plan.
For blended families, a carefully prepared will can help clarify who is intended to benefit, how the estate should be distributed, and reduce uncertainty for those left behind.
☎️With more than 43 years of legal experience, Grope Hamilton Lawyers can assist with carefully prepared wills and estate planning advice tailored to your circumstances. Contact our team on (08) 8231 0088.

💡Do you have an unpaid invoice or account that has been sitting unresolved for months, or even years?
🔎In South Australia, an older debt should not be assessed only by asking whether money was once owed. Timing can be an important legal issue.
Legal action to recover a debt must generally be commenced within six years from when the debt first arose. In some circumstances, that period may be affected if the debtor has acknowledged or confirmed the debt in writing during that time.
For a creditor, this means the history of the debt matters. The date payment became due, any later payments, written acknowledgements, email correspondence, payment reminders and previous communications may all need to be reviewed before further recovery steps are taken.
🔑At Grope Hamilton Lawyers, we assist clients with debt recovery matters by reviewing the documents, the timing of the debt, and the legal issues that may affect the next step.
If you are dealing with an older unpaid account and are unsure whether it can still be pursued, contact Grope Hamilton Lawyers on (08) 8231 0088 for advice based on your circumstances.

💡A gaming room can be an important part of the value and operation of a hotel or licensed venue. For a buyer, it is not enough to consider how the room looks during an inspection or how many machines appear to be on site. The more practical question is whether the gaming area has been properly approved, and whether the existing layout supports the way the buyer intends to use the space.
🔎In South Australia, changes to the part of a premises defined as a gaming area may require approval. This can include relocating or extending a gaming room, or making alterations connected with an increase or decrease in the approved number of gaming machines.
🔑This can become particularly important where a buyer is considering future refurbishment, a different floor plan, an expanded gaming area, or relying on that space as part of the commercial value of the transaction.
If the approved gaming area is not reviewed early, issues may arise later with fit-out plans, approval requirements, timing, additional costs or assumptions about how the venue can be used.
If the gaming area forms part of the value of the venue you are buying, it should be considered before the deal progresses. Speak with Grope Hamilton Lawyers on (08) 8231 0088 for practical guidance aimed at helping you avoid unexpected approval issues, layout restrictions or costly changes to your intended use of the space.
