According to Mercer’s latest Quality of Living City Ranking (2024), Vienna is the city with the second highest quality of living in the world (behind Zurich and ahead of Geneva and Copenhagen). At the same time, Vienna is only ranked in 24th position in Mercer’s Cost of Living City Ranking 2024 (with Zurich and Geneva in 3rd and 4th place and Copenhagen in 11th place).

But seeing these efforts come to fruition almost instantaneously – it has only been a few months since we received Anastasia’s Austrian passport – takes it to a whole different level.

We will continue cheering on Anastasia at the WTA 1000 tournament in Madrid and bringing top athletes to Austria.

Did you know, you could obtain Austrian citizenship if your Jewish ancestor fled Austria in the 1920s? Here’s why!

In March 1925, Hugo Bettauer, the best-selling author, was brutally murdered by N**i sympathiser Otto Rothstock. But Rothstock was not convicted of murder!

Instead, he was sent to a psychiatric hospital and walked free just 20 months later.

The Vienna Administrative Court says that after this high-profile murder, the Jewish population in Vienna could no longer rely on Austrian state protection against N**i attacks.

We think there was no state protection against N**i attacks on the Viennese Jewish population before that either.

However – the point is disputed and there is no case law yet!

In this video, we explain the prevented return principle under Section 58c of the Austrian Citizenship Act.

Since September 2020, victims of N**i persecution and their descendants may be eligible for Austrian citizenship. One key pathway is through the prevented return principle, which applies if your direct ancestor was unable to return to Austria between January 30, 1933, and May 9, 1945 due to fear of persecution by the N**i regime.

This also includes cases where an ancestor, born abroad, was prevented from moving to Austria for the first time during that period.

Since September 2020, victims of N**i persecution and their descendants can acquire Austrian citizenship under section 58c Austrian Citizenship Act.

In this reel, we touch on the principle of prevented return.

To acquire Austrian citizenship under this principle, you must have had a director-line ancestor who was Austrian and prevented from returning to Austria between 30 January 1933 and 9 May 1945 because of fear of suffering persecution at the hands of the N**i regime.

This principle also applies if one of your direct-line ancestors was born abroad and was prevented from moving to Austria for the first time between January 1933 and May 1945.

Since September 2020, survivors of N**i persecution and their descendants have been able to acquire Austrian citizenship in privileged citizenship proceedings – an overdue gesture of the Austrian parliament towards families who were forced to leave their homes in Austria between the 1930s and the 1950s.

Having helped hundreds of people obtain Austrian citizenship in “section 58c” proceedings and contributed to leading case law in this area, we feel that this International Holocaust Remembrance Day also offers the opportunity to take stock and share our experiences.

While opening up a path to Austrian citizenship under section 58c does not even come close to compensating the affected families for the murderous injustice they suffered after their country embraced N**i tyranny, our clients have often shared that receiving Austrian passports has helped them to come to terms with a family history of persecution.

Many say that the process allowed them to discover something new about their Austrian roots and, in some cases, to obtain closure.
Some of our clients have taken the opportunity of Austrian citizenship (and with it, EU citizenship) to relocate with their families to Austria, while others have exercised their right to free movement and relocated to other countries in the European Union.

The above provisions on Austrian citizenship are not perfect. This is why we regularly challenge negative citizenship decisions.

Despite all imperfections, Austria’s new rules have allowed for the granting of citizenship to thousands of Holocaust survivors and their descendants, and it has been our honour to have obtained Austrian citizenship for several hundred of our clients.

Prior to acquiring Austrian nationality in regular naturalization proceedings, successful applicants are required to renounce their citizenship(s) within two years from the issuance of a preliminary decision on Austrian citizenship (provided that renunciation is factually and legally possible in the countries concerned).

Having said that, sec 10 subsec 6 of the Austrian Citizenship Act allows for naturalization without prior residence in Austria and without renouncing other citizenship(s) if the Federal Government confirms that naturalization is in the special interest of Austria because of the applicant’s extraordinary achievements as an athlete, artist, entrepreneur, or scientist.

A few weeks ago, eos successfully completed privileged naturalization proceedings for tennis professional Anastasia Potapova, winner of six WTA tournaments for singles and doubles (and counting).

Following her naturalization, Anastasia became Austria’s highest ranked player on the WTA tour and will represent Austria in the Billie Jean King Cup in 2026.
