Keeco, the exclusive licensee of the Hookless intellectual property for shower and window curtains in hospitality and retail, has won a $3 million judgment against two home textiles companies in the Southern District of New York. The court found that Kartri Sales Company and Marquis Mills International had infringed on Keeco's brand intellectual property by selling unauthorized shower curtains. The damages include Keeco's lost profits on all of Kartri's accused sales, as well as triple damages due to willful infringement from Feb. 27, 2015, onward.

This case is a reminder of the importance of protecting intellectual property assets, such as federally registered trademarks. Keeco CEO Christopher Grassi notes that Hookless is a federally registered trademark that can only be used by authorized licensees, and Keeco will continue to enforce its rights vigorously and hold accountable those who copy Hookless designs.

A study by Dentsu International and Microsoft Advertising found that over 90% of consumers are interested in brands that are committed to and can demonstrate they are making sustainability a priority. Companies that fail to implement this as a strategy will face a consumer backlash in the coming years.

With the potential to attract consumers, companies have embraced green marketing in various ways, including adopting brand names that suggest green, using words such as sustainable, compostable, green, organic, eco, zero impact and natural, featuring glossy shots of beautiful landscapes in their advertising, using green-based color schemes for advertising. However, consumers are skeptical of such marketing unless the company can transparently demonstrate the factual basis for making such claims.
