We are honored to share that, in Thematic Bulletin No. 12/2025 on the financial valuation of properties by the Agency for the Treatment of Property (ATP), the Supreme Court has published Decision No. 00-2025-144 (38), dated 23 January 2025, as one of the selected cases of significance for the development of judicial practice. In this case, the claimant was represented by our law firm’s partner, Attorney at Law Erilda Papagjoni.

In its reasoning, the Supreme Court reaffirmed an important principle: in cases concerning the financial valuation of properties recognized for compensation, the public authority (ATP) bears the burden of proof to demonstrate the lawfulness of its decision and the correct determination of the property’s cadastral category, based on official documents and the evidence administered in the proceedings. The Court further held that the lack of a full and proper investigation, as well as the improper shifting of the burden of proof onto the private party, constitutes a violation of both substantive and procedural law.

Almost three years ago, our legal firm, through it partner Erilda Papagjoni, acted as one of the legal representatives of the Appellant in the CAS case 2023/A/9436.

Today, we are honored to note that in its 2025/01 CAS Bulletin, the Court of Arbitration for Sport (CAS) included award CAS 2023/A/9436 among its selected leading cases highlighting key legal issues that contribute to the development of CAS jurisprudence.

In this award, CAS set out eight legal significant findings, covering both procedural and merit base issues. Of particular interest is the issue examined by the Panel, namely whether, as contended by the Appellant, the selling club is entitled to benefit from the application of the sell-on fee to subsequent sell-on fees received by the buying club under future transfer agreements relating to the player.

Our managing partner Mr. Idlir Peçi, moderated the high-level panel “Pre-trial Detention: Challenges and Alternative Measures”, held on April 7, and organized by the Council of Europe.

This event brought together distinguished speakers, including the President of the Supreme court of Albania and the Prosecutor General of Albania and distinguished stakeholders such as, judges, prosecutors and representatives of various institutions.

The conference was structured into two panels, featuring notable international contributors, including the Deputy Prosecutor General at the Supreme Court of Cassation of Italy and a Judge of the Court of Auditors in Lisbon, Portugal.

Key topics included the need for a shift in mindset regarding the application of alternative measures, the effective coordination of responsible institutions, and the use of electronic monitoring as a better safeguard for alternative preventive measures.

The conference was concluded with a rich exchange of ideas and the gathering of valuable insights on improving the current approach to pre-trial detention.
