Not every professional with Green Card potential already has all the evidence in place.

That’s exactly why strategy comes before filing.

For EB-1A, the case is built around your professional achievements and recognition. Depending on where your profile stands today, it may be possible to identify gaps and strategically develop legitimate, documentable evidence over time.

For EB-2 NIW, the logic is different. A key part of the analysis is your proposed endeavor: what you intend to pursue in the United States, why it matters, and how well positioned you are to advance it.

You don’t have to wait until your profile feels “complete” to start thinking about your Green Card.

The first step is understanding which strategy makes sense for where you are today.

HAYMAN-WOODWARD offers a free initial consultation to assess your profile and explore potential immigration pathways.

The E-2 visa can be a valuable pathway for investors and entrepreneurs who want to develop and direct a business in the United States.

But it is not a simple equation of:

“Invest a certain amount = get the visa.”

There is no universal minimum investment that guarantees eligibility.

Instead, the investment must be substantial in relation to the type and cost of the business. The capital must be genuinely committed to the enterprise, and the business must be real, active and operational.

The investor must also be coming to the United States to develop and direct the business, rather than simply make a passive investment.

Nationality is another key part of the analysis.

The E-2 is available only to nationals of countries that maintain a qualifying treaty with the United States.

Examples include Italy, Spain, Portugal, France, Germany, Japan, South Korea, Canada, Mexico, Argentina, Colombia and Chile, among many others.

That is why an E-2 strategy should look at the full picture:

nationality, investment structure, business model, operations and control of the company.

The strongest E-2 cases are built around much more than capital alone.

Can a foreign-trained doctor get a Green Card before obtaining a U.S. medical license?

Yes. U.S. immigration for doctors and medical licensing in the United States are separate processes.

To practice medicine and treat patients in the U.S., an international medical graduate must meet applicable licensing requirements, which may include exams, certification, graduate medical training and state-specific requirements.

But obtaining a U.S. medical license is not necessarily a prerequisite for pursuing permanent residency.

Depending on your education, professional experience, research, publications, achievements and other qualifications, foreign-trained physicians may qualify for employment-based immigration pathways such as the EB-2 NIW or EB-1 Green Card.

This means an international physician moving to the United States may be able to pursue two paths in parallel: building a Green Card strategy while completing the requirements needed to eventually practice medicine in the U.S.

There may also be opportunities to work before obtaining a medical license, including positions in clinical research, public health, healthcare education, academia and other non-clinical fields, depending on the role, qualifications and work authorization.

If you are a foreign-trained doctor considering immigration to the United States, your medical license and your immigration status should not automatically be treated as one single process.

HAYMAN-WOODWARD evaluates your professional background and potential U.S. immigration pathways before you make your decision.

A new immigration battle is heading to federal court.

New York, Washington, D.C., and 21 other states are challenging a new federal policy tied to the “public charge” rule.

The policy could give immigration officers broader discretion when reviewing green card applications, visas, and admission to the United States. One of the key concerns is that an immigrant’s potential use of public benefits, including healthcare, food assistance, and housing programs, could play a larger role in those decisions.

The states argue that the rule may discourage legally eligible families from using public assistance because they fear it could hurt their immigration cases.

The lawsuit also raises a broader legal question: whether the Department of Homeland Security can expand the definition of “public charge” without Congress changing the law.

State officials say the policy could also have a major financial impact by reducing participation in programs such as Medicaid and CHIP, potentially leading to billions of dollars in lost federal funding.

The lawsuit was filed in New York and seeks to stop the rule from taking effect.

California, Illinois, and Colorado are among the states joining the challenge.

If you already own a business outside the U.S. and are considering expanding into the American market, the L-1 visa may be an option worth exploring.

This visa category allows qualifying companies to transfer executives, managers, or employees with specialized knowledge from an overseas operation to a related company in the United States.

And the U.S. operation doesn’t necessarily have to be fully established yet. The L-1 can also be used in certain “new office” cases, when a foreign company is establishing a new operation in the U.S.

But simply opening a company in the United States does not automatically make you eligible for an L-1. The relationship between the companies, your professional history, and other requirements all matter.

If you already have a business abroad and are considering expanding to the United States, understanding the right immigration strategy can make all the difference.

The American Dream has never been just about dreaming.

It’s about the work behind it.

The courage to start over. The long days. The risks. The sacrifices. And the decision to keep building, even when the path isn’t easy.

Today, we celebrate everyone who came to this country carrying more than a dream, carrying the determination to turn it into something real.

To build careers. Businesses. Families. Futures.

Because behind every American Dream, there’s work.

Happy Labor Day. 🇺🇸

Many international students believe that once their F-1 journey comes to an end, their options in the United States become very limited.

But there is another visa category that many students and recent graduates simply do not know they may be able to consider: the O-1 visa.

The O-1 is designed for individuals who can demonstrate extraordinary ability or significant recognition in their field. And that does not necessarily mean having decades of experience or already being at the very top of your profession.

Depending on your profile, accomplishments built while you are still in school can become part of that analysis.

Research, publications, awards, relevant projects, media recognition, significant contributions to your field, judging the work of others, and other forms of professional or academic recognition may all help support an O-1 case.

That means some students and recent graduates may be in a position to start exploring an O-1 much earlier than they realize.

Another important point is the category’s approval history. USCIS data has shown O-1A approval rates above 90% in recent years.

That does not mean an O-1 is easy, automatic, or guaranteed. Every case depends on the applicant’s individual background, the strength of the evidence, and whether the requirements of the category are met.

But it does mean that this is an option worth knowing about, especially if you are building your career in the United States and starting to think about what comes after your F-1.

Your F-1 may have been your way into the United States. It does not necessarily have to be the end of your American dream.

If you are currently a student or recently graduated and want to understand whether the O-1 could be an option for your profile, schedule your free consultation.

Some immigration situations should not be put off.

Being out of status, needing to refile, or already being eligible for Adjustment of Status are all situations where timing, strategy, and a careful case evaluation can make a difference.

In addition, immigration forms will change starting September 18. If you already need to make a decision about your case, this is another reason to understand your options now rather than wait until the landscape changes.

We have seen recent refile and out-of-status cases result in approvals. This does not mean every case will have the same outcome. Each situation depends on your qualifications, immigration history, and individual circumstances.

And for those who currently maintain valid status and are eligible for Adjustment of Status, we are in a particularly important window to consider filing.

If you are in one of these situations, now is the time to understand what options may be available in your case.

We currently have special conditions and limited availability for case evaluations and strategy.

Send us a DM with OUT OF STATUS, REFILE, or ADJUSTMENT to speak with our team.
