Over the past week, social media was abuzz with a story about a man who was a no-show at his traditional wedding. The woman, visibly distraught, allegedly shared her ordeal online, sparking widespread public outrage over the man’s unbecoming conduct. This incident brings to mind the Latin maxim “Ubi societas, ibi jus” — which translates to “Where there is society, there is law.” The maxim underscores that law is an essential component of any organized community, indispensable for maintaining peace, order, and social harmony.

In the context of marriage, the law does not merely regulate who may marry and at what age; it also provides remedies in situations where one party has made a promise to marry and later fails to honour that commitment. This is where the doctrine of breach of promise to marry becomes relevant — serving as a legal mechanism through which an aggrieved party may seek redress for emotional, financial, or reputational harm suffered due to such a breach.

Over the past few weeks, Facebook was abuzz with questions concerning a certain Facebook account whose owner had passed on, but it seemed to be active. Some people said it was a ghost.... that version was exciting, but not really in touch with reality. This got me thinking about what happens to a person's social media presence and the value they added and derived when they die, because there is value that should be retained from one's online presence. Not only is the value in sentimental form, but also come to think of the monetised pages and platforms where people work hard to create value and earn thousands of dollars. Should it all die when one dies? Is that not part of the deceased's estate?
taking it a notch higher, there is the S v Lloyd Chiyangwa case in which Llyod was hired to be the crypto manager of Dr. Guramatunhu. It is alleged that Lloyd converted some of the crypto into hard currency and used it for his own benefit. The case is still before the courts. However, it's not the outcome I am concerned with, but rather the case got me thinking of what would happen to one's cryptocurrency in the unfortunate situation of their death or their incapacitation.
