Important note about lease and usufruct

In a lease,the occupant has a specific limited time of the right to occupy and use the property.The occupant can improve,change the substance or character of the property in question.

Usufruct
In usufruct,the occupant has temporary use of the property and has no right to improve/change the substance of the property but to enjoy the fruits that comes with occupation of the same.

In Zimbabwean law it allows for the occupation and use of real property for a limited time.

What is Usufruct
It is the temporary right to the use and enjoyment of the property of another without changing substance or the character of the property.

Usufruct continued

The usufuructuary can use the property without changing their substance,eg land, buildings, movable objects such as cars,bycles,bikes etc, however nature may alter them through wear and tear over time in use .

A usufruct terminates by an express written renunciation, however a creditor of the usufuruct may cause to be annulled a renunciation made to his/her prejudice.

Lien
It is a right to keep possession of property belonging to another person until a debt owed by that person is discharged.

Caveat
It is a legal notice that informs claim of interest for a property and during a property transaction.No transaction may be allowed to go ahead on a property under Caveat notice..A Caveat can significantly delay the purchase and sale of a property, acting as a formal notice to the public that there is an interest in the land or Property in question.
A person /individual who has lodged the Caveat is called the Caveator.

It is the right of ownership in material
things.The Property in question must be visible and tangible eg land,house,
Car,bike etc

Incorporeal Property
It is Property that is intangible,there is no physical substance in it but a person or company can own and transfer the same eg brand identity/knowledge or intellectual property.

It is the part of the earth's surface that is not covered by water/ the solid surface of earth that is not permanently submerged in water,most but not all land is situated at elevations above the sea level and consist mainly of crystal components such as rock,sand, soil and sometimes ice.

2.Rights
Property right gives someone the right to use a thing.

Real Right
This is a right that is attached to a thing rather than a person eg ownership,use,usufruct, mortgage,and predial servitude.

Personal right
It prevents another person from dealing with Property in a given manner or requires them to deal in a given manner with the property.
