IT IS NOT ALWAYS NECESSARY TO FILE FOR DIVORCE WHEN MARRIED COUPLES ARE FACED WITH SERIOUS MARITAL PROBLEMS, SOMETIMES YOU CAN MERELY SEEK JUDICIAL SEPARATION.

judicial separation allows a spouse to petition the court for a decree or an order that relieves them from the obligation to cohabit (living together as husband and wife), without ending the marriage itself.

Unlike a divorce, judicial separation doesn't dissolve the marriage, it merely allows the couple to live separately while remaining legally married. The marriage continues to exist for all intents and purposes but the spouses are relieved from living together.

If you resume cohabitation (living together as husband and wife) then the order for judicial separation lapses. This kind of order can be resorted to for example were spouses want to cool down before they can reconcile or where divorce is objected to for religious reasons among other situations.

If a couple just separates on their own without a court order for judicial separation, maybe one spouse would go back and you cannot chase him/her because there is no court order, or a spouse who is not financially sound may find it difficult to seek maintenance (financial support) from the spouse with financial muscle.

Judicial Separation in Zambia is governed by Part VI of the Matrimonial Causes Act No. 20 of 2007.
