MY HONEST OPINION ABOUT THE BURIAL OF THE LATE SIXTH PRESIDENT OF ZAMBIA, DR. EDGAR CHAGWA LUNGU.
As someone who understands the law and also cares deeply about this country, I believe this is a sensitive moment for both the family of the late President Edgar Lungu and the people of Zambia.
President Lungu was not just a family man but he was also a former Head of State. This means that he was both a private person and a public figure, which signifies him being the asset of the public . His legacy belongs to his loved ones, but also to the nation he dearly served.
Legally, the family has every right to decide where he should be buried. But at the same time, the government and the people also have a role to play in giving him the honor he deserves as a former president.Saying that there is no law that supports the government to have a say in his burial, means that we don't know what the law is. There are precedents in place, having similar issues, according to legal process, that's a law. Determination of whether the public interests overrides the family interests can only be determined through case law as it stands now.
I therefore believe that this should not turn into a disagreement, although disagreements have already been created but we can rectify that.. Instead, the family and government should sit down and talk things through, with mutual respect. A good way forward might be a national funeral led by the State. Respecting the family wishes is very important as well, but in this scenario, it will set a bad precedent for the future.
As a student of law, I conquer with the standing of the Attorney general, if the government and the family fails to come to a consensus, then let the independent and impartial part determine the end results of the whole issue. In that way, we are also adding to the laws of Zambia, less another similar case arise in the future. However, like I stated earlier, it will be a bad precedent.
