Managing Poor Performance Legally

You can’t dismiss an employee for poor performance without following a fair process.

✔️ Clearly identify the issue and expected standards
✔️ Address it early and allow the employee to respond
✔️ Provide support (training, guidance, clear expectations)
✔️ Set measurable targets and timeframes (PIP)
✔️ Monitor progress and keep records
✔️ Issue warnings if needed
✔️ Hold an incapacity hearing before dismissal

⚠️ Dismissal is only fair if the employee was given a real opportunity to improve and a fair process was followed.

Simple rule:
Poor performance = Can’t do the job → Support first

Can You Be Fired Without a Warning?
Sometimes YES, but only in very specific circumstances.

In most cases, you cannot be dismissed without warning or a fair process.

Before dismissing an employee, and employer must have a valid reason and must follow a fair procedure (i.e., warnings and disciplinary hearing)

Exceptions, you can be dismissed without prior warnings if the misconduct is very serious ie Theft, fraud, assault, violence, gross insubordination and serious dishonesty.

A disciplinary hearing is still required, but no prior warning is required.

A dismissal is unfair if no valid reason exists or no fair procedure was followed.

Employee vs Independent Contractor

This difference affects tax, rights, and legal responsibility.

Employee:
Works in the business
Under employer control
Fixed salary
PAYE + UIF deducted
Protected by labour laws (leave, dismissal, etc.)

Independent Contractor:
Works for the business
Works independently
Paid for results
Handles own tax
No automatic labour law protection

⚠️ In SA, calling someone a “contractor” doesn’t make it so, misclassification can lead to penalties and claims.

Bottom line:
Employee = in the business
Contractor = for the business

What to do after a car accident in South Africa?

* Stop immediately, leaving the scene is a criminal offence
* Check for injuries & call emergency services
* Take photos/videos of everything (vehicles, scene, surroundings)
* Collect details from all parties & witnesses

* Report to police:
– Within 24 hrs (if injury, death, or damage)
– Next working day (minor accidents)

* Get your Accident Report (AR) number
* Notify your insurance

Claims:
* You have 3 years to claim from the Road Accident Fund (RAF)
* If not your fault, you can claim for damages (loss of income, pain & suffering, repairs)
* For serious cases, speak to an attorney
